morowolfspirit | I've been threatened, insulted, and need to resolve this... But where do I start? |
Alright, for about three months now, myself and my husband have been in slight debt. We can't buy food every two weeks with my pay check and have to go thin sometimes. He just started a new job and hasn't gotten paid yet. I'm on a very low income, $750 every two weeks. We have bills that total half of that pretty much, and the rest is used on food and gasoline. Anyway, my question is, we have a credit card that has gone unpaid for a bit. It wasn't a neccesity that we bought, so I let it go. Now they have lawyers calling my house at 9pm (usually time I go to sleep to get up for work) to only insult me, mock me, threaten me with punishment through my work (military, so, it can happen, and I've seen it happen) all because I can't pay what they want me to pay. I have to get back at them by 2pm tomorrow and I already told them I couldn't because I don't get off of work till 4pm. Another thing is they want it in full. I can't pay $1100 by 2pm tomorrow. What can I do? Just pay my card slowly? Additional Details I'm very afraid of what my work can do, and will do, about this, especially since I've seen it done before. I told them that yes, in installments, I can pay it, but they 100% refused. I can only probably squeeze out $75 a month an a little extra here and there if my husband brings home some extra.
Basically, I just really need to know... What can I do to make this right before I end up losing pay or getting demoted and losing pay even more. |

Tell them to take a hike, basically. By law, they cannot contact you at work, or contact your employer, after you have told them not to. Write them a letter telling them to quit calling you, and tell them that all communication with you should be by US mail only. After that the only action they can legally take against you is to sue you in civil court. You will have plenty of time to work a solution before that happens.
Remember, harassing a debtor for payment is a violation of the Fair Debt Collection Practices Act. |

By law you are allowed to make payments, they cant deny your payments and say it is not enough. If it went to court you would have the upper hand if you can prove they denied your offer of payments. I have been in this position and know this is fact. Good Luck |

You have to pay the money, but you only have so much money, so you pay them what you can, and you continue to do so until it's paid off. It's as simple as that. You have to make the minimum payments every bill, so just do it. Don't take any of their personal jabs at you. If I were you I'd record the phone calls. You can buy a cheap suction thing at an electronics store that sticks to your phone. Plug it into a tape recorder. If you can't do that, maybe just stop answering the phone. If they can't talk to you like a human being, they'll be forced to write you. |

Go and seek debt counseling ASAP. They will help you out and come to an agreement on payments that are affordable to your case. It may also be necessary to file for bankruptcy, once the credit card hear the word" bankrupt" they'll idea back off. I wish you all the luck. I've walked the walk. (The $75.00 shows that you are trying and that will be taken into consideration.) |

Do not answer the phone calls. If you want them to stop calling, you are going to have to pay them. It's a simple as paying even $10 a month, every month, on time. As long as its on time, and you never miss a payment, you are showing them your willingness to comply and pay the debt. I suggest looking into online banking, like bank of america, and set them up as a payee and have a check mailed to them automatically from your checking account every month so that you don't have to think about it. Eventually the calls will stop. Those people are trained to tell you whatever they have to tell you to get their money. Even if you only scrape by with a little income every month, you can still spare $10 a month. You can always get a second job at a restaurant working one day a week and make enough money to pay it. Good luck. |

You have to take time during your lunch or break to call them. Most of them will make arrangements...if you call. If you explain your situation and give them an amount that you can pay each week or each month or every two weeks, the calls and threats should stop. Avoiding it only adds stress to you. Also, try to pay them a little bit, you really don't want to ruin your credit. Good luck to you. |

You should have never told them where you work or that you had a job for that matter. What I think you should do when they call you is ask to speak with their supervisor if they're being rude. And mainly they're just trying to scare you into paying. But they cannot make you pay in full. Usually what collections do is offer you a settlement (about 70-80% of the amount) or split the bill in half,in thirds, etc. And this is sometimes when the account is in the final stages. If you can tell them what you are able to pay (if you can). And usually what they want you to do is tell them an amount you'd be able to pay each month until it's paid off. Always offer to pay the least amount so that if they try to make you pay more you would still be able to give that amount. But even if you have to lie or make up the most sadest story, go for it especially if you're worried about losing your job. And because if that happen you definately won't be able to pay. But do not accept them talking to you like crap. We've all made mistakes and missed payments. Good Luck! |

If they keep harrassing you, pull the plug on the phone. If they come to your house, call the cops. Stay far away from payday loans. Good Luck. |

Go to your local grocery or Wal-Mart and send them say $50 Western Union, it will cost @ $15 to send it. Keep the reciept, this will prove that you made a effort to pay, in good faith, on the debt before their deadline. Make sure the account number and date is on the reciept somewhere, and maybe this will get them to back off some. If they accept it, good; if not get an attorney! Also, if I remember right, this creates a new payment history, and you will only have to pay this amount each month ( contact a professional about this ). Do not post-date a check or give them your bank account number, the way they are harassing you, some of these people will say they are only going to deduct a certian amount and then turn around and wipe you out! |

Since I doubt you can afford an attorney to help, I would seek assitance from one of the many consumer credit counseling companies.

I hate to say it, but your husband needs to go get a payday loan. (Excuse me while I wash my mouth out with soap). When payday comes for your husband, he must pay off the payday loan completely.
After that, put your credit cards, all of them, in a pan of water and freeze them solid in your freezer. I am not kidding about this.
Then, practice this discipline: pay with cash, or don't buy it at all. |
