I'm afraid 'caveat emptor' (let the buyer beware) applies here particularly harshly. If the car was originally bought on HP and has been subsequently sold on to you, the legal title to it remains with the Hire Purchase company, and they have the right to demand the outstanding balance (£24,000) or repossess the car.

Consult a solicitor without delay on this one. You should also notify the police, regarding tracking down the private seller (assuming you cannot now contact him yourself).

Whoopsie! should have forked out for an HPI check before buying.

Seek professional legal help. A couple of hundred quid spent on solicitors fees could save you a few thousand.

the finance company are not tracking you down they are tracking down the car - they can recover it sell it and still go after the person who took out the finance unfortunately you will be a car down - this is why we should always check the car details through a data check before buying
its a nightmare i know

unfortunatly for you the car belongs to them if the payments have not been kept up.
I would drop in to your local police station and talk to them
see what can be done, by rights the person that sold it to you did it illegally knowing they owed money, they can be prosecuted so do something before the guy bolts off
see if you can get police to lean on the seller to refund your money

why would you even pay £7000 for a car that didnt have a title to it? That should've been a red flag right there

maybe they have the wrong person ... you could be a victim of identity theft.

demand that they prove the amount owed with written documents.

if their response isn't fully satisfactory, you need either a solicitor or the police depending on the response you get.

Bad luck - you bought a vehicle which you did not have good title to - they are perfectly within their rights to repossess it.

Sorry to say - it belongs to them if it was not paid off by the person taking out the laon for it.

You probably won't even be able toget the money back if you bought it privately unless you take them to court.

First and only Golden Rule - always check and get all the facts about a car's history - they have every right to take it from you and there is nothing you can do about it

Legally the car loan is not yours.

However they can take possesion of the said vechile, as it was on finance.

The person who sold it to you has clearly broken the law as legally he had no right to sell the said vechile.

But it belongs to the finance company, you should be able to do a check to see if the vechile is encumbered.

My suggestion is to seek legal advise or go to your nearest police station in the hope you may get your 7,000 back

It is your problem in that you did not secure a valid title, free of liens. If you buy a car from an individual, you must inspect the title to see whether there any outstanding liens. Theoretically, you have recourse against the seller -- if you can find him.

Let the finance company know that you bought it privatley, its the person you bought it offs fault

You are not legally obligated to the finance company with no binding contract signed. However, you do not have legal title to the vehicle either evidently and may have to sue the party for the sales price in that you do not own your car friend. Sorry.

OK question! If you did not pay cash then how do u think you got the car on your good looks. Come on you need to get smarter in finances or get someone to help you. I would look at any paperwork & go to a lawyer its free for 30 mins & ask them what to do. OMG
