I am a small business manager. A debtor owes $250 and moved out of state. He owns no real estate.My options?
BTW, in my business, all the income is in small "bites"-- $25, $35, etc. so I'd rather not just let $250 just slide. The debt is 2 years old (and not bc we didn't try to collect). Times are hard for everyone including me. The debtor just refuses to pay saying "go and send me to collections." Any suggestions on collection? Thanks.

Try small claims court. Usually, there's no need for lawyers. Just take the paperwork to back you your claim. If you get a judgment, then you still need to collect. Your court should have some forms for garnishing wages and bank accounts.

But seriously, if the guy is unemployed, then he's probably judgment proof. You could write it off for tax purposes.

But there is one exception: if the debtor is in the military, then you could call the commanding officer and ask for assistance. It's worked for me in the past.

first of all report the debt to the credit bureau, so at least if someone runs a credit report they see that he owes it, and sometimes if he tries to get a loan, until all those reported debts are paid, he cant get loan....next turn over to small claims court and if he doesnt show up you can get a garnish or a warrant so if he is ever stopped for a traffic violation and they run a warrant check they will take him to jail...dont give up thats what he wants you to do

Hire someone to go and get the debt owed like a good low ball rough biker that always work for me and my crew. Laugh if you want but I am speaking the truth

You can sue him in small claims. If the debt occurred in your area, you should be able to sue him locally. If he doesn't show up for court, you will get a default judgment.

With a judgment, you can go after his bank account, garnish wages, and even lien his property. There are fees for all this things and you may want to consider the cost versus return. You may even have to hire a collection agency to collect on the judgment.

Look into selling the debt to a collection agency, I don't know where you do it, but look into reporting him to affect his credit rating.

You could sue him, but if he moved out of state, you probably would have a heck of a time getting him served. But even if you got a judgement against him for the 250, it doesn't sound like you'd have any way to collect it. You can attach his bank account or any property, but that's up to you to track down and find any assets. In other words, you'd spend way more than you could ever hope to recover.

You could give his case to a collection agent. I think they will pay you, but they will go after him and bug the heck out of him until he pays.
You could also take him to small claims court, and try to get your money that way.
You could also get him to pay you smaller amounts.
if he isn't scared of this going to collections, then he probably isn't intending on paying it back.

you need to decide whether or not it's worth it to take him to court. there are court costs, time off of work, etc. to think about.
