Put a letter to thgem stating you do not owe this and your reasons why you believe this. State that you will not write to them again regardimg this. Send it registered or at least recorded delivery. If they write to you again, return their mail UNOPENED.

If they seriously think you themn money they will send a court summonds - then you can state your reasons why you believe you do not owe this. This is usually the end of it all.

First of all stop ringing and writing to them cos each time you do they gain information on which they believe they can base their claim. Info such as date of birth, your employment status and residential status etc. If they call round at the house just tell them to get st*ffed. They will have to send you a final notice for the outstanding bal and then a summons. If a summons is recieved you have 3 options. You can pay it in full. Not likely! You can admit you owe the debt and make an offer of payment. Ha! Or defend it by advising the court that the debt is not yours. The company will have to prove the debt is yours. If you are not sent a final notice then they will not be able to apply to court. And if they issue a summons and the debt is not yours then they will have to pay the costs and £150.00 compensation.

Harassment is against the law especially when it is aimed at someone who does not owe any money to the person who is harassing.

Go and see a solicitor immediately.

In the USA, it is the Fair Debt Collection Practices Act that applies here, not so much the Fair Credit Reporting Act. Read a FAQ on it here:

Do not contact the Collection Agency (CA) by phone or email. Always contact them by certified mail, return receipt requested (CMRRR) and keep copies of the letters you send. You need to keep a paper trail should either you or the CA decide to go to court.

You should send the CA two different letters. To learn what you should write in these letters, go to the message boards at www.creditnet.com and start posting.

One letter is a cease-and-desist letter, telling them to stop contacting you by phone. If at the time you receive the green card from the CMRRR, they continue phoning, you can win up to $1,000.00 per violation in court. Be prepared to present proof (recordings) of when they called, and documented proof of the date and time they called. Your word alone may not be enough in court.

The other letter is a validation of debt request. You request that they validate the debt as genuine. Do not accept their internal computer printout. They must show proof that they purchased your debt from the previous CA or the original creditor. As soon as the green card arrives from the CMRRR, and you're sure that the debt is not yours, contact the 3 Credit Reporting Agencies (CRAs) and begin disputing the trade lines on your credit reports left by the offending CA.

How can they be harrassing you and ignoring you at the same time?

if they phone or turn up then ask for a breakdown of what you are supposed to owe, this uaually keeps them at bay for a while.
