I am being sued for a $6,000 credit card in New Jersey from a collection agency. What do I do?
The card was with Providian and I had it way back in 1998. I was making monthly payments until around 2001. I ended up losing my job and shortly after moved to New Jersey. I have been living and working here since 2003. Should I just try to make montly payments or go to court? Or can I just forget about and if I do what will happen?

Having good credit is an absolutely priceless asset. Your credit score has already been affected by this (whenever the credit card company turned over your account to a collection agency). At this point, you cannot negotiate with the credit card company, only the collection agency. My advice to you is to contact them ASAP, ask to set up a payment plan, then make the payments on time. Your credit can be repaired, and it would be wise to repair it. On the flip side, it can also be further damaged (if you do nothing).

Someday you'll want to buy a home and poor credit will mean that mortgage companies will not work with you.

Check the statue of limitations for your state. It's likely that it has passed and you are not legally obligated to pay this debt to them.

You need to determine exactly when you stopped making payments. That will determine the Statute of Limitations (SOL). Check here for your state: http://www.fair-debt-collection.com/SOL-by-State.html

New Jersey is a little confusing but it's either 4 or 6 years. If your last payment was in 2001. The debt would be beyond the SOL. You mentioned you moved to NJ. Check the SOL for the state where you incurred the debt. Chances are it is also beyond the SOL.

You can go to court and use the SOL as an affirmative defense. Some states have rules about tolling the SOL when you move out of state. So you still might lose in court.

If the collector is just threatening and you have not actually received a summons, you should send the collection agency a letter pointing that the debt is beyond the SOL. They may just go away.

If you make a payment or arrangements you will extend the statute of limitations. The best course is to show up in court. These collection agents and their attorneys count on people being scared into making payments. They also count on people not showing up in court and getting default judgments. If you stopped making payments in 2001, then most likely you can defend in court by claiming statute of limitations has run out. If they have proof at the court, the judge will likely push the parties to come to a settlement offer. You should go to court and ask to adjourn for time to get counsel if you feel they may be able to prove their case. I suggest contacting an attorney for at least a consultation.

Look up the statute of limitations in your state, most are 4-5 years. If you are beyond the statute of limitations you win automatically, check it out and show up, if they call you let them know that will be your defense they might just drop it. If you need extra time ask them to validate the debt they have 30 days to do so. Because of the financial situation of the banks right now (housing problems) all should watch out as they will be getting more aggressive in trying to collect even old debts because profits are way down. Be wary, be educated, know the laws and fight back

first off again some piss poor answers at the begining. Now for your question, are you 100% certian that your last payment was in 2001 pull your credit reports for all three bearaus' it should tell you your last payment, once you see a thirty day later that is when your SOL starts. I am betting this debt is not even on your credit report, or they re instated it "illegal by the way". New Jersey has a 6 year statue of limitations to win a suit, with you not making any payments past 2001 this is past the states SOL. The other thing that concerns me with this case is where did you live at the time you took out the debt? ALL states have diffrent SOL's with 5 years as the average, but if you lived in another state with a longer SOL at the time you took out the debt, they can use the state with the longer SOL. But only a handfull of states has SOL longer than 6 years. type in a search "SOL debt"
So here is my suggestion, i am betting that this debt is out side of the SOL and you most likly will not have to pay a dime. Providian has nothing to due with this, and sold it to a Junk debt buyer. They bought this debt for little as 100 dollars, most of the time they just scare the crap out of people. Now with you they filed a law suit hoping you do not show up "even if it is passed the SOL" they will win. Then they can garnish your pay.
It would not hurt to talk to an attorney on this issue first thing on Monday morning, it may cost you a couple of hundread dollars much better than 6k. They will send a couple of letters and get this case dismissed in a real hurry. Again i think you got a clear defense with the SOL, the worst thing you can do is not show up and forget about this.

you don't owe that much money. most of that being interest, the credit card company is supposed to sell your debt into collections after about a year maybe two.. Instead of selling it then, they kept piling on interest compounded tby interest, knowing darned well you couldn't. Definitely only pay the orig anal amount you owed. what was that about 1500? That is all you legally owe. Definitely take it to court after offering to settle. Haven't you ever seen all the comericals where some law office is going to settle your credit card debt without bankruptcy, for pennies on the dollar? That is how they can do it. If they have been pursuing you the whole time then they can have the statute of limitations extended,

go to court, get a laywer, the staute of limitations should keep them from being able to get any money out of you. if the last payment is passed the statute of limitations you might win. these credit card companies try to harrass you into paying, but contact a lawyer who will help you fight it.

dont make a payment, becuase it will start the statute of limitations all over again.

sign it and file it, you will never here from them again. They arent about to take you to court. But if you dont file a response they get a default judgement.

answer every question. You will never here from them again. They are after the 99% of the people that dont answer.
