has anyone ever done this, I want to hear from people who have done this with an attorney and what the outcome was. I have $35,000 in credit debt and I can not work out payment agreements and I can not pay them unless I do something over 5 years at least. Any advice? Additional Details I have contacted an attorney and she advised me that is the best way to go, I am just looking for people who have done it, I am only 28 and I do not want to ruin my life if that is what happens. |

I filed last year...Chaper 7 17K in debt, mixed debt, not just credit card debt....cost me 1200.00, discharged in 02/08. File as the result of a divorce, best thing I could have done. Approved a few months later for a credit card, only allow myself one, small limit, and already have increased. I pay it ontime, actually early most the time and approved for a motorcycle loan on a brand new harley davidson, which we pay on time, and have excellent incomes. So, there is life after bk....you can review these websites and may help with your decision...www.totalbankruptcy.com www.bcsalliance.com or www.usbankruptcy.gov All of these websites offer excellent information on debts, credit and bankruptcy issues. I've never filed but I know a lot about the issue....
If you qualify to file for Chapter 7 under the new "means" test then you should probably take that route....Just remember:
You can only discharge debts through Chapter 7 once every eight years...so if you file now and you find yourself in a worse financial situation in two years, for example, you're going to be in a bad spot...
Second, if you file, make sure that you and all your dependents (if you have any) are fully covered with health insurance. Not having health insurance after filing for Chapter 7 puts a person in an extremely vulnerable financial position...A common medical emergency like an appendectomy with two nights in the hospital could easily surpass $35K.
Filing for BK will not produce the catastrophic damage to your credit that you think it will....The first two years you will for sure have bad credit...but after that, your score will start to go up and I've seen people have FICO scores in the 700s in just four years out of BK.
Don't let anyone smear or guilt-trip you for making this decision if you have to...especially all the people who like to quote Dave Ramsey who think that BK should always be avoided....this is ridiculous advise that only benefits credit card companies...Of course BK should be avoided if at all possible...but sometimes it is needed. Do what's best for you and your family. In light of the fact that all of us are going to be bailing out Wall Street fat cats...no one is in a position to slam you. |

Be aware that you must get credit counseling from a government-approved organization within six months before you file for any bankruptcy relief. This might even provide you assistance to avoid bankruptcy.
Also, you want to be sure which kind of bankruptcy you want (13 or 7). In order to file a Chapter 7 bankruptcy case, you must satisfy a “means test.” This test requires you to confirm that your income does not exceed a certain amount. The amount varies by state and is publicized by the U.S. Trustee Program at www.usdoj.gov/ust.
As I'm sure you know, this will stay on your credit report for 10 years, and will affect your ability to buy a car, obtain credit, buy a home, get life insurance, or sometimes get a job. |

chapter 13 sounds right but tell them that you are considering this action and ask for a settlement in writing first. Send them no $$ till you do get it in writing and never give them access to your checking account |

I suggest you get on that 5 year plan and pay the money back the right respectable way even if you have to nickle and dime it for sometime in the end it would be a great lesson learned for you in not getting that deep into dept at a youg age. |

I would try credit counseling first. It's cheaper and bettwe for your credit. I've been doing it for 2.5 years almost and I am much happier than I would've been in bankruptcy. But I did not owe that much.
Anyway I think it is a better option. It will take more than 5 years but it took a long time to get your into debt and it will take you a long time to get you out. Even if you file for bankruptcy, then it will be on your credit for 7+ years, so eitehr way you're in it for the long haul.
Of course the attorney saiid that. She's make money off of it! |

You need to access why you borrowed $35,000. If you bought thinking
you could pay later, then you only need to change how you do things.
If you bought things that were more expensive than you could afford,
again you need to change how you do things. If you used credit
because cash was not available this is a big problem.
If you can make some payments, it is best to put these funds in a
bank account (not yours) and accumulate it until the credit card
companies choose to negotiate. Your credit is depressed and will
remain so for 3 years. THERE IS NO GUARANTEE that after 3 years
all will be well. "Do not tell any CREDITOR that you have money
saved".
DO NOT AGREE TO ANY PAYMENT ON ANY ACCOUNT UNLESS
ALL CREDITORS AGREE TO A PAYOUT PLAN.
Make sure any agreement is in writing and you have 14 days to comply
with the payoff requirements. FIRST step: Stop payment on all accounts.
SECOND step: Create a written list of all your credit bills. You need
the amount due NOW - the credit card company will try to raise this
sum with interest charges. In two or three years they will make an
offer to accept an amount lower than your account list.
DO NOT AGREE IF ANY CREDITOR FAILS TO SIGN OFF ON THEIR
PORTION.
This approach may tie up your credit for 5 to 7 years, but you will never
have to report that you filed bankruptcy. "Charge Offs" are good for you.
When a credit company charges off your account, "Interest" is no longer due. The only funds due are those at the time of charge off. |

I would meet with a bankruptcy lawyer but they drastically changed the laws a few years back making it almost impossible to file based on credit card debt alone. My fiance had filed and just made the cutoff before October 2006 I believe.
