I am in total debt! I have a collection agency hounding me and I need to know what my best solutions are!!?
Im in debt between 5,000-7,000. (Don't Judge me I made a mistake!) Now they are tripping me out and I am approved for a loan from school that I will be getting after the holidays but I am scared that I can't wait. I have tried every avenue and they will not budge with me. I want to make a balance transfer but have closed my credit card accounts for now and I wanted to know if a debt consolidation loan or anything like that is actually helpful. Does anyone know of a place where I can get a quick loan or anything helpful for me to solve this problem??? Please help me! (And I can't borrow money from any family or friends that is not an option for me) Oh and Ideally I would like to pay it off in the next few weeks before I get "Sued" apparently.Thanks!

I am actually currently in collections and I have been trying to get a monthly payment with them but they are telling me no and that I need to pay two payments of 3500 which is insane and I can't do that right now. And in regards to the loan, I am approved for one but I am waiting to recieve the money which I will probably get after the holidays, and I am saying that the collection agency is telling me I might get sued by then by the main creditor.

I am an ex CEO of one of the nations largest debt collection agencies. Here is what you do:

1. Write a letter to the collection agency certified telling them that you dispute the debt in its entirety and that if you place it on the credit bureau you will sue them to high heaven. Something like:

I have never received a letter from you in my life until a week ago. I dispute this in full. Please do not contact me at work, and or at my home any longer.

Please be advised! You have been notified that this is disputed, and if you put it on my bureau you will be sued for damages.

2. remember that this is no big deal. Even if you get sued. They don't wanna sue, trust me. It cost money and time. You could lapse it out years. What I would do after I sent the letter is to relax, and enjoy the holidays. Now if a sheriff or a strange guy comes and gives you papers to appear, then please respond to the papers. You could keep requesting a new hearing date for years and years. I have seen debtors do it for 4 years.

3. If you really want to settle it (I wish I knew the creditor, so I could tell you what your options really are) then draft a letter to the creditor offering 50% off. Tell them your destitute, and are broke. I have had some debtors even have a friend back date a promissory note for 200K dated two years prior and have them list it with the same agency!!!!! The agency will then start to go after you for that promissory note which is bunk. The agency will realize that you owe people money once they get that debt and settle for 50%. Once it's settled, the friend will "pull back" the debt from the agency.

I could go into detail, but without knowing who the original creditor is, I cant help. If its a hospital that would be great. Most people dont know you DONT have to pay hospital debt and there is a way to get out of it....

The collection agency will keep calling, even after you tell them not to call again. so next time they call offer a monthly amount to them you can afford, usually they will agree. Explain to them you don't have the full amount and the monthly payment you are offering is the most you can afford. They might want a financial statement showing how much your rent/mortgage, auto payment, insurance (health and auto) all your monthly expenditures and you total monthly income.
Goo luck, you don't have to pay them next week if you don't have any money, they actually don't want to sue and usually don't they just want some type of payment arrangement.

Because they will not budge with you, there isn't much you can do except just send in payments anyways. that's what I have done. I guess they can still send you to collections but at least you would be paying and looking as if you are making an effort.

Wow, you mean that they are taking away a loan you had? I don't understand that part.

Just pay something... if you end up going to court, show you are at least making an effort right?

It will take a while for you to get sued. It's a long process. Most likey they will file suit and get a judgement against you. They can't take your school money as it's not income. They can garnish a checking account so don't send payments via check but via money order. Get a new checking account and never use it to send money to creditors. Use that for your student loan $$ if it does not go directly to a college.

Tripping you out (quit doing weed and quit drinking...it worked for me)

Send them a letter disputing the debt and read up on the FDCPA and then follow those guidelines on the websites. You can cut out the calls with a similar letter, requesting that you will only deal with them in writing. After that follow-up with a cease and desist letter noting you will only work with the original creditor. Consult a consumer protection attorney if it gets really bad. If they are out of line the attorney may be able to assist.

One dispute the collection that buys you 30 days for them to prove that it is yours. Next if in collections how old is this debt? If past the statute of limitations then you are in good shape (most states around 5 years) You might get sued worry about that when it happens if it is in collections then the main creditor does not own the loan anymore and will not and cannot file suit. They sold the debt for pennies on the dollar. If you are past the SOL let them take you to court that is your defense and they will lose in which case you can file suit for $1000 for going against the FDCPA rules. Right now the best thing you can do is educate yourself on the fair debt collection rules. Don't panic and make a mistake just Google it an educate yourself as to what your rights are

Relax, they see you are afraid. Tell them to go get #@!'ed and their attitude will change. All the credit card company will do is add charges to your account and then when you have the money to pay them they will knock these charges off...

Your credit is important, but it is civil not criminal. We are in a recession. Everybody will deal and settle now.

man, its already in collections, so dont give your money away. They want to play hard ball with you so play right back. . . hire a debt settlement company and only pay them half (if its 7000 then they will only get 3850) beside they cant garnish student loans. Another thing, FCRA laws. . . after you told them not to call you it is illegal for them to call you except to tell you they are taking other action. Threaten to report them to the state attorney and they will change real quick.
