I am wondering if anyone out there knows how to get a collection agency to quit harassing you 12 times a day.?
These people from Applied Credit Card call my son at least 12 to 14 times a day, 7 days a week, and they are literally harassing him. They know his financial situation, but they continue to call and harass him up to 12 or 14 times a day (NO KIDDING!). How do you stop them from doing this? Our telephone company (AT&T) will NOT block 1-800 or 1-866 numbers. Applied Credit Card calls on their 1-800 number every time. He earns below minimum wage where he works, and I earn minimum wage where I work, so we cannot help one another. In other words, we cannot afford a lawyer to help us with this. Does ANYONE have any solutions here! PLEASE HELP!!! THANK YOU!!!

I will give you a couple of different ways to handle this problem..

1 - As others have stated, a cease and desist letter will be the easiest way to end this matter... However, understand, a cease and desist letter does not cover the original creditor.. Thus, if Applied Credit Card is the original creditor, this may not be successful..
2 - Their conduct is teetering on violating the fair debt collection practices act (once again, this is a gray area, because if Applied Credit is the original creditor, you have not protections)..
3 - State laws usually mirror federal laws AND protect the debtor from any creditor calling... Remember, you can tell someone to stop calling, and they must comply.. If they continue to, file a complaint for harassment. This can also become a civil matter as well worth recovering money..

Now, here is the one I like the most...

4 - Get a nice loud instrument or something which makes loud noise (I prefer a whistle or a bike horn)... When they call, have a little fun with them.. When they start speaking, pick up the phone and blow the whistle or horn or whatever kind of instrument in their ear.. Enough times of that will get the point... That is tough justice there for those people... And guess what.. You will get a kick out of it too because you are putting the stress back on them..

If you want, send me an e-mail (click on my user name) and send me your state.. I will research your state's collection laws and will provide you with the appropriate course of action.. If all else fails, I can guarantee you #4 will work...

You do have rights in this matter. First of all, they have rules to go by. They are not to call before 8AM or after 9PM. I doubt they should be calling on Sunday either, but I don't know for sure about that. If you tell them either by phone or letter not to call you again, the law says they can't. If they continue they are in violation of the Fair Debt Collection Practices Act. This is a federal rule. You can look it up and see what else they are violating. Keep in mind that your son still owes the debt. I hope this helps you somewhat.

ask them for there address and send them a cease and desist letter I don't know the correct spelling I hope you get what I am trying to say also make sure you send it certified mail return receipt requested. But be certain they can still sue you if the statue of limitations has not ran out

Crazy Cat lady is correct. You (your son rather) needs to send this company a limited cease and desist letter, stating that they are only to contact him through US mail. Send it certified return receipt, and if they continue calling after they have received that letter they are in violation of the FDCPA and you can win an easy $1000 from them in the way of a small claims court lawsuit.

Also don't bother changing your phone number, they can usually track down the new numbers fairly easy.

Is this your personal number and not your son's? You need to inform them to cease calling this number that it is harassment. Or don't answer the phone on those calls. You have caller ID? Or change your number to an unpublished unlisted one. Eventually they will stop.

change phone number, make it private, get an answering machine and turn the volume down - screen ALL your calls - works for me with telemarketers - 99% hang up without saying a word

contact your state attorney collectors can only contact once a month everything else is harrasment or ignore it will fall off your report in 7 years.the constitution clearly says no american has to pay for bills i have over 20 million dollars in bills i dont pay and they just fall off every 7 years i have never been denied for anything everybody wants to give me credit but i just deal with cash no banks,loans,nothing just cash and very happy everytime someone calls i call my aunt the nevadastate attorney and she slaps them with harrasment charges they never call again

I had this same problem. I was getting calls at 5 o'clock in the morning! Next time they call, tell them that you are doing your best to get the money to them and that you are working on it, then tell them that you want to be put on a "no-call list". Then explain to them that you are getting too many calls all day long. I'm not good at being mean but this is what I finally had to do, just have to be stern with them.

Write a letter telling them not to contact you by phone and when they call tell them that you dont want to be contacted by phone, but if you do that they can contact you once more to inform you of there plan of action. Do not try to dodge the debit it will catch up with him. And he will have to be the one that talks to them they can not talk to you about the account unless your name is on it.
