 I am in the middle of filing chapter 7 bankrupt and need to get a car loan?
Does anyone have any ideas of who might approve us for a car loan when we are in the middle of a chapter 7. Most if not everyone say we need to wait until we are discharged. Thanks for the help....

I would call the CC company and ask. It sounds like you have a valid case. Their bad bookkepping could harm your personal finance. But then again you have to look at the flip side. You DIDN't call teh CC company to tell them the HAD'T charged you yet either.

This is a case where no wrong doing was done, but a major annoyance was. Waiting five months to post a charge is obnoxious and rude. I agree with the others who say you shoudl pay what you owe but I would also take it a step further. Contact the restaurant, letter or email, and tell them that no respectable business would delay so long collecting a charge. Five months is ridiculous. Best and only thing to do is complain to them about it. Who knows, you might get a free meal out of it.

There's the possibility it didn't get posted sooner because your card was refused when the transaction was posted. Most vendors will try several times before writing it off as a bad debt . Some vendors will just keep hammering away at it until they hit a time there's enough money in the account to cover the charge. If you owe it, pay it !

No you cant dispute it, you already said you ate there. They may have misplaced your receipt but whatever their reason for waiting you still have to pay.

I suspect they can do that, and if this is a valid charge you probably should pay it (ie the restaurant just made a mistake - we all do).. Nonetheless I'd still dispute this charge just on principal. Write in a letter (to the credit card company, of course) that you have not been to that resaurant in 5 months so you think this charge must be in error. The credit card company will then handle everything. I suspect they'll come back to you and say this is a valid charge from way back but you still have to pay it.

Nonetheless the restaurant (who will get contacted by the credit card co) will get the picture that they need to be more timely about this is the future, and who know maybe there is some limit on how old these things can be.

If you ate the food and didn't pay cash, you owe them for the price they charged you. Some companies are SLOW becuz of the stupid accountants they have working for them. I once had a similar situation occur. I wasn't charged until almost one year later for food we had eaten. I challenged it because my card was directly tied to my checking account and all my checks specify that it is only good for 6 months. I didn't have to pay. Check with your bank as to the rules regarding this.

Of course they can! If you ate the meal and they charged you the correct amount, then you just got a gift of not having to pay it for a few months. I would, however, make certain that this is the only time you've been billed for it...check your old credit card statements carefully. Also -- start paying cash for your meals out. It lessens your chances of identity theft, and people who pay with plastic spend more than those who pay with cash. Don't buy things unless you can pay cash for them.
