I am unemployed. It has come to the point where I am behind on 9 of my 17 credit card accounts (I am in debt to four banks, as I have multiple accounts with three of them). I am getting about 20 calls a day from these people. Household Bank by itself called me no less than 18 times on Friday. I set it up so they only call my cell and then I keep that on silent most of the time. I don't answer because it would be a waste of my time and theirs. I have been told that I need to be working to file for bankrupcy. Also, my parents put my name on one of their bank accounts in case of an emergency. It is not my money. This is a large account (about $40,000). Would this prevent me from filing for bankrupcy? I would go to my parents, but they would not understand. They do not believe in being in debt and would never let me live it down. I really don't know what to do. I might have some money soon from doing freelance work, but it won't be enough with late fees and over the limit fees. Additional Details I am seeking work and need the phone for my job search. I got laid off and haven't had much luck in finding another job. |

While it may seem pointless to talk to these companies, you need to answer the phone!
I went through a similar thing about a year ago. If you never answer your phone then the companies will assume you are not paying them back, and go after your credit. It seems scary, but if you get into contact with them at least they know that you have the intent to pay them. You can set up a different payment plan that suits you. Companies will work with you!
Don't declare bankrupcy until you consult a professional.

get a 2nd or 3rd job and start paying your debts.

I would definatly speak to a free lawyer about bankruptcy. I did a chapter 7, and the same as you, had a bank account with my mother. Her name appears first on the account, so when they pulled my files about all my bank accounts by using my ss#, that account with my mothers name on it first didn't show up. Nobody ever knew about it. I only had a couple of hundred dollars in this account, but nobody ever saw it. Ask a lawyer about this. Doing this ch.7 was the best thing. You must remove ur name from ur parents' accounts
immediately . Ur creditors are not interested in seeing
you bankrupt . It is doubtful if they will sue you for small
amounts because of legal costs. All they can do is harass
you and place you under pressure. Be strong until
you get a job.

First, you can tell them to stop calling, and by law they have to.
Put it in writing, and the calls stop.
BTW, the $40k can be tapped as part of a bankruptcy - if your name is on it, it's considered to be your asset. If they take it off, it will look fraudulent, so the best thing for them to do is to take the money out and put it in an account that your name is not on - and do that immediately.
Instead of writing your parents off, perhaps you can seek financial advice from them on how to handle the problem. So they won't let you live it down, but do you think they want to see you living on the street? Better to play it honest and take your lumps now. |

You need legal advice. I believe there is free legal help available for people like you. Also ask someone you can trust like a teacher, professor, clergyman. You are certainly not alone. Please get the help you need, and hopefully you will get employment so you can eventually get back on the track. Good luck. |

Get as much work as you possibly can, to start making payment plans with them... even if you only send $10 a month to each, it will show that you are making an attempt and hopefully slow down the calls/harassment. With that money tied to your name, I highly doubt you can do bankruptcy. That means, call one of the consumer credit counseling services and set up payment plans through them, to make it easier. They can normally talk the creditors down a bit as to what they will accept as payment -- however, you MUST make regular payments, even if they are quite low. You can't just ignore creditors - you owe the money, they don't owe you anything, and by not paying, it just makes them increase their interest rates to the rest of the world who pay their bills on time. |

I may be wrong so you can look into this option but I have heard that if you talk to them sometimes you can settle the debt for a lower amount so when you began to get paid a little you can call one by one and see if they can settle. You can also consolidate. As for the calls get accustom to it or change your number but eventually pay the debt it much better off that way. Hope you find work soon. I know that must suck. |

Look, I don't condone not paying your bills but If you are in a cash crunch situation then you have to do what you have to do. They charge plenty of interest and they will wait!
You may want to check the caller ID before you answer your phone or unplug it.
Before you pay off those credit cards with your "hope to be" money I would talk to the credit card companies and see if they will renegotiate the fines and/or interest with you. Only pay off the ones who will work with you and let the others wait until you are able to get them paid off. |

To qualify for all those cards and that high a credit ceiling you must have been making serious money.
They don't just give credit cards out...you have to be judged worthy for it; and the amount they allow you to have is based on your worthiness too.
So, you must have had a serious income.
I'm sorry to hear you were laid off, or fired, or whatever the case was....you need to get a job asap.
Then you can qualify to file for bankruptcy. |

Tell them you're unemployed and that you'll pay it when you can. Sometimes credit cards will have a special plan where they'll even pay your months bill for you ( minimum balance ) in life emergencies ( accidental deaths, unemployment etc. ) Get a job and get out of debt. I don't know how much your debt is, but cut up your credit cards NOW! Seriously 17 is WAY to many i've had 2 for my entire life. for future references,don't spend what you don't make and can't pay.

If your name is on that account take it off! any assettes your name is on, can be repossessed and taken to pay off of your debt.
tell them you're unemployed, and will pay them when you can. Then change your number and don't put the phone in your name and they won't track you. My lord, I went into unpaid bills after my first daughter and just the 1 or 2 calls a day was enough to send me wild, but in the end they're just people trying to get paid. Most couldn't care less if i paid or not, just were doing their jobs. Some were REALLY rude. But eventually they stopped calling and thats about the time I FINALLY paid them off roflol.
Good luck with your parents, thats a tough one. How old are you? Try to repair your credit and pay them off, i'm really happy I did because Its just about time for me to buy a house and you don't think about needing credit when you're young and charging everything but 10 years down the road, it became important to me. So try and repair it, consult a lawyer about a bankrupcy and see if its an option for you. Sounds like it could be.
oooh! try and negotiate a deal with the credit cards. Thats what I did for mine and they reduced the interest by like 2/3's for real! i ended up paying only the balance I was due by the time we "settled" they literrally took off all of the interest just to get paid :)
