If they take you to court and garnish you check they wont get the $2,000.00 a month that they want. The Judge will look at your pay and other bills and deciede on a payment. If you dont have it they wont get it. |

They cannot just take your money. They have to get a court order, which they cannot do without you having the chance to appear in court and explain your circumstances. The court will determine a reasonable amount that you must pay per month towards this bill, but will not leave you unable to pay the rent and utilities and buy food. They can demand you sell all of your cars (unless there is no other way for you to get to work without a car - and that's rare) and all your "toys" such as boats, ATVs, motorcycles and use that money to help pay off your debt.
It can be rough. Even if you declare bankruptcy, the court will not permit you simply to erase the entire debt - you will still have to pay some of it. See a lawyer and good luck... |

number 1 reason why people file for bankruptcy, unpaid medical bills. depending how much is owed you might want to consider this option |

Typically hospitals will send the accounts to a collection agency much quicker than the doctors will.
If any of that is billing for the doctors go to them and ask that they reduce the bills and explain the circumstances.
Go to the business office of the hospital and work out a plan that might include something like 50% of the total at a reasonable amount that you can pay monthly. If they say no then explain your only other option will be to file BK because of these medical bills you will never be able to pay off. They might rethink 1/2 compared to little in a BK. |

Isn't it past the statue of limitations to be sued or are hospitals a different set of laws ??? You did say 1996 right ? |

Can't get wages garnished without a court judgment. It is illegal for a debt collector to threaten to garnish wages. Your state might have a consumer protection law which prohibits an original creditor (the hostpital) from making such a threat.
When did you last make a payment? The statue of limitations might have expired. Contact an attorney who has experience handling consumer debt issues - stay away from debt consolidation / credit counseling services - most are ripoffs. |

i have found that if you just pay them what you can, like $100 a week or even bi-weekly, it will hold them off of trying to garnish anything or sending you to collections, it will just not stop the harrassing phone calls. sorry. |

If they get a judgement against you through the courts to garnish your wages, they will be required to send you an exemption form first. If you believe you are truly unable to live with less than you are paid, fill out the exemption form and send one back to them and one to your employer (this will all be in the instructions). This will buy you a month or more and the courts may find that your wages cannot be garnished. Right now it sounds like they are just trying to scare you into paying. Usually with medical bills, they will accept any amount you are able to send. I would suggest sending them what you can, even if it's just $5 or $10 a month. However, if they have already turned the account over to collections, you will have to work the payment amount out with them. Good luck |

Is the hospital a county hospital or a private hospital. If is is a county to state hospital they have to treat you whether you have insurance or not and work a resonable payment plan out with you. If they are private, then go to them and tell them your financial situation and work out a more realistic payment plan. Let them know if they do try to garnish your wages you will just quit your job and go elsewhere. It will be up to them to find out where you are.
Most creditors will work with you if you go to them and truthfully tell them whats going on.
Good Luck. |

before anyone can garnish your pay they have to obtain a judgement through the courts. Then if you default on the judgement they have a right to ask the court to enter a wage attachment. If they are saying this prior to getting a judgement this is legally harrassment. A bill collector can not legally threaten to do anything they are not able to do. The first thing you need to do is get a tape recorder. If they're threatening you, you'll want to have proof. Your next step is to send the collection agency a letter {certified} advising them to cease and desist all forms of contact other than those in writing required by law. One of two things will happen. Either A} They will leave you alone, or B} they will sue you.
If they sue you don't panic. The court papers will give you a chance to tell your side of the story. You may never even have to go to court. Write down your situation. Acknowledge owing the money and let them know what you can afford to pay per month. As long as it's a reasonable amount the courts will usually enter a stipulated judgement for the payments
good luck |
