I suspected the check might be a problem, so I went to its "issuing" bank to cash it. (Yes, this was one of those scams where I was supposed to have deposited it into my own account.) Anyway, the teller almost cashed it, but the check failed the last test and she told me that it didn't clear some account number test or some such. Which is what I expected. This is by way of saying that I would have expected the same work from any bank. If they gave you the money, they have the check. They are the ones left holding the bag. So what they sound like they're saying is that they screwed up but want you to take the hit. Generally, the last one left holding the counterfeit bill takes the loss because no one else wants it.
So, CAN they ask for the money back? Of course. Are you required to give it back? I think not because they already "verified" the check as good by giving you the money, which is what a court would look at. So, don't spend it (in case I'm wrong), and wait to see what the bank does.
Oh, BTW, God would tell you to return to the owner what was stolen, even if you aren't the one who stole it (which might be the legal basis for going to court--that you're in possession of "stolen" property.) Such thorny issues are why I first recommend not spending the money. |

Certainly. The bank is going to go after the person who received the funds. You get the pleasure of going after the dirtball who wrote you a bad check. |

they CAN NOT! That is point in you taking it to them. They may try to be cute and ask for it but they legally can not, it was the tellers responsiblity to verify the check. Make sure they don't try putting it against your credit bureau |
