I co-signed on a loan?
I cosigned on a loan for my ex-boyfriend back in Dec. of 07. He assured me that he would refinance the vehicle in 6 months and have my name removed from the loan. It is the 7th month and he has not done this. To top it off he has not made the July payment on the vehicle as yet. I sent him 2 email one informing him that it has been 6 months and to let me know if the refinancing process has started yet and another of the statement from the car financing place showing that he is behind on payments.

Am I able to take him to court or mediation to force a refinance or can I petition the court to force him to sell the vehicle.

HELP, I dont want this to negatively impact my credit. I am stressing

Contact the lending company and tell them what is going on and see what they can do to help you out if not then you will have to make the payment on the car til this gets worked out

You are on the loan, but not title, so you can't force a sale or a refinance. I'm sorry but I just think you are stuck. If he doesn't pay, there is nothing you can do to save your credit, short of making the payments yourself. Sorry but this is just a life lesson you may need to remember for the future.

You cosigned - that means you guaranteed the loan in the event that he does not pay. Verbal "assurances" to refinance are meaningless. As a cosigner, you are on the loan but not on the title (you are not the registered owner). This is why you should NEVER cosign loans.

If he is not paying the bills then you are required to. If you do have to pay for the bills from the vehicle then your ex is entitled to pay you back. You can also call the bank and tell them your situation.

You can take him to court only if the account goes into default and the loan company goes after you. You can't force a sale of the vehicle, as you don't own it. If you credit is being damaged, it is possible to sue your ex-bf for damaging your credit, but damages would be hard to show.

are you crazy. he could not finance it to begin with. there has to be a reason for that. and what makes you think his credit would be any better in six months. you can take him to small claims but most of those cap the max amount at 5000. i hope you learned your lesson. now a days credit is everything. don't let some idiot ruin yours.

I am not really sure. You may be able to take him to court but I would get a free consult from a lawyer and talk to them about it. Also, maybe he is not checking his email you may have to call or if you dont want to call text him and let him know you are getting phone calls and maybe scare him and say they are coming to get the vechicle if the note is not paid by the last day of the month. I would though use this as a lesson and never co-sign for any boyfriends in the future. But I would try everything I can to make sure the car note gets paid or something. Hope you can get it resolved.
