I have a slight problem i was with this guy for 4 years and evenully we got a car together and i co-signed for
it but both our names are on it now we're broke up and i want to get the car out of my name i have not seen nor heard from him in 3-4 years now nor have i seen the car how do i go about getting the car out my name i don't want the car and the only way i know of is to get him to refinance the car, but he has horrible credit and he's not cooperrating with getting out my name and i don't know where to find him PLEASE HELP!!!

Refinancing is truly the only way to do it. If he doesn't owe much it sould be that hard, specially if its a newer car. yes, the interest rate will go up, but if its worth more than he's financing he should be able to do it.

If he's nto going to do it, you have two choices.
1) Subscribe to a credit monitoring service (14.99 a month at truecredit.com for all three bueaus and scores) and IF and ONLY IF, he's making ontime monthly payments, let him keep it. If he's had it 4 years there must be only a year left or so, right?

2)Take the car and make the payments. You said you dont want it, but this might be the only way to protect your credit.

If you let him keep it,make sure you get your name off the registration the second you can. If he were to wreck with no insurance, they can go after you as well, and you could owe thousands just cus your name is on there.

You can't get out of a co-sign because the point of co-signing is you guaranteeing that if anything happens over the life of the loan you will assume responsibility. Has he been making the payments on time and what is the length of the loan. There's nothing you can do about this and it sucks but hopefully concern for his own credit and fear of repossession will be reason enough for him to make timely payments.

You are stuck unless he magically becomes a nice guy. As the co-signer the bill belongs to you and the car belongs to him even if he doesn't pay. That's what co-signer means. You signed to pay for HIS car if he can't or won't. This is truly one of life's lessons learn from your mistake and never co-sign for anyone again and that includes family.If someone asks run!!!!!!

Talk to a finance company, or a lawyer. Also, as the other person said: you've learned a hard lesson.....NEVER co-sign for A-N-Y-B-O-D-Y!!!!!!!

From now on,

1. Never mix sex and credit. It always leaves a foul stench when the "session" is over and you see the person you slept with for who he/she really is!

2. If this "guy" is not co-operating with you, you are pretty much stuck like Chuck, because you have to understand . . .

WHEN YOU CO-SIGN for someone

you are saying the following:

1) I understand the person for whom I am signing is a credit risk and possibly even a "flight risk".
2) But since I love this person I am signing for, I will guarantee to pay his debts in case he fails to fulfills the terms and conditions of the credit agreement.
3) I will co-sign for him, with no financial benefit and no expectation of profit or return of capital. (in this case, no return of car!)
4) I am soley responsible for all negative consequences incurred for co-signing for this person, including possible damage of my own credit rating.

Now, all of the above are true, but why the hell sign for someone . . . .only you can provide THAT answer.

But this is what you sign up for when you co-sign for people who do not have the creditworthiness necessary to secure the loan in the first place.

And put yourself in the creditor's shoes. The creditor has a legally binding contract with two people, thus, he can try to collect his money through two different avenues. Why would give you an "out" because you see this trifling "guy" for what he is?

You can get a lawyer, if you like, but he can not UNDO what has been done. He can not VOID the original credit agreement and he can't change the car's title since the car's title is in possession of the finance company who wants their money!

They will get their money from this non-descript guy or from you!

You can forget about "this guy" refinancing the loan because that is why he came to you in the first place. His credit and character, for that matter, smells worse than sanitation! NO one will give him credit or a benefit of a doubt.

But unfortunately, you did. And co-signing loans is a volunteer effort with no inherent benefits.

Try contacting the finance company that you have the car financed with. See if they can give you the information that you need to find him. Since your name is on the account you should have access to the information. Find out if hes making the payments and if they can give you an address for him. Ask there advice on what you should do. I'm sure that having him refinancing it is the only way to go but maybe they could help you. If all else fails try the DMV or public records to locate him.

The car in both of your names, then do not worry so much as getting your name off. Anything happens it will be on his parade.
the best outcome you have out of this is should he die then the car will become yours no matter what.So sit back and relax or else go the title company and pursue taking your name off.

If all payments have been made you can sign off the title by going to the Department of Motor Vehicles and giving your name, vehicle information and explaining that you no longer have knowledge of the vehicle nor want its legal obligation. Depending on the state and the way the title is written you may not need his cooperation. Good luck!
