If they take you to court and get a judgment, they might be able to depending on what state you live in. The federal maximum is 25%....but the laws vary from state to state. NY state is 10% for example. Wages can't be garnished in a few states like Texas and PA. See link below for specific info for your state.
If you qualify for Chapter 7....you may want to include this in your options for dealing with this level of debt. |

They most certainly can and they can take all but what you need to maintain a basic lifestyle - somewhere to live and food. They do not have to allow you entertainment allowances or anything like that.
So what you should do is consolidate all your debts under one creditor at the lowest interest rate you can find, sell some of the cr**p you bought on credit to make a lump sum payment and then start living within your means until the debt is paid off. Otherwise your credit will be ruined for life and they will still maje you pay it back anyway.
Credit is a huge trap. It ends up in this situation too much. There should be much better education in the community about credit, as I bet a lot of that $90,0000 is accumulated interest from just paying the minimum monthly balance all the time. |

I believe they can if a judgement has been put in place. I don't know how much, but I'm sure it's no small amount.
The bankruptcy laws have changed in the past year, so you can't just file and wash your hands of it.....it's a headache either way. I would talk to a lawyer and see what your options are.

your best out is to file Chapter 7 Bankruptcy. if some lawyer wants to run you through Chapter 13 for 5 years, on some ridiculous payment plan that makes more money for them, find another no BS lawyer that will clear your credit card debt in Chapter 7, in 30 days.
assuming of course that you haven't filed bankruptcy in the past year or so. you can keep your house, car, and other things. the honest lawyer will explain it to you, based on your specific situation.

Why don't you contact the credit card company and ask them how you can pay down the debt? Most companies will lower the interest rate if you are making an honest attempt to pay your debt. Remember you are the one who took the credit and ran up the bill. First cut the card in half. |

I've never heard of it, but I'd ask a bankruptcy attorney. It is possible that something like that might happen, but you'd have to go before a judge, explain your situation (with the help of a lawyer) and then something might be worked out via another party. I don't thin the companies themselves can be trusted fully to do this, as they might take more than they deserve.
Have you tried to work out deals with the banks themselves first? |
