Every state has a Statute of Limitations law. The creditor has a certain amount of time to take legal actions to collect on your debt. If they fail to do so, they forfeit that right. Look at the link below, as it discusses this, and will give you the SOL for your state.
Also, this can only be reported on your credit history for more then 7 years, so this should have been erased by now.
Ignore these people! You have already paid this debt by suffering with bad credit for the last 7 years.
One other note....I recently had a discussion with some collection agents in my area (they been trying to recruit me again)....It seems that a number of medical offices/hospitals have decided to sell off a huge number of past due debts to these guys. Many are well over 8 years old.
Michigan has a Statute of Limitations of 6 years, making these debts legally uncollectable.
Now why on earth would someone pay big bucks to purchase thousands of dollars of junk debts?
Very simple. They are gambling on the FACT that most consumers do not understand their right, and don't know the law. These guys will harass the debtor, just like they are doing you right now! They may even file a lawsuit, counting in the fact that you will not know how to file an "affirmative defense".
So DO YOUR HOMEWORK and read the laws! The only weapon you have to fight these guys with is knowledge! Read the link below! |

Its a myth that debts are wiped after 6 years.
What actually happens is that the debt drops off your credit file after 6 years, however the debt stands forever, or until its paid.
However, if there is absolutely no contact between the lender and the debtor for a complete period of 6 years then the debt becomes "Statuate Barred".
What this means is that the lender can no longer take you to court to recover the debt. You still owe the money to the lender, and they can still try and collect it from you.
Because they can't take you to court to collect the money however, if you refuse to pay then there is effectively nothing that they can do about it.
Usually debt collection agencies will try bullying tactics to get you pay, but they know the rules and know they can't take you to court, so if you stand firm and refuse to pay, they will usually give up in the end. |

Please check the state you are in. all states are not six years.It is six years from the last payment in most states.It will take work ,but the debt can be removed from your record. |

Actually the FDCPA says they have 7 years from the date of your last payment. Although they can no longer sue you for the debt after this time, there unfortunately is no time limit as to how long they can harrass you in an attempt to collect. Often people will break down and make some sort of small payment which starts the clock running again. Sucks huh lol |

In the UK if they really haven't chased the debt then after the end of the 6th year (7th anniversary) the debt lapses as "out of time" - but like Pete Docherty's court appearance the other day.
However if you moved house without informing the creditor then it is more complex and they have the 6 year period from when they "discover" you rather than from the original debt although they are supposed to be reasonably efficient at doing that.
In the UK the debtline can help. |

6 years is right if you do not contact them, as soon as you do the 6 years begins again. The exception could be council tax but the citizens advise bureau would be able to help. you could even call them instead of going in. Please don't contact the creditors until you've spoken to someone. |

Its not as straight forward as that. After 6 years the debt cannot be pursued through the legal system, the creditors can still ask you to repay. There are different things to be considered. It also depends on whether you are in the UK and where you are in the UK. If someone hasn't needed your money for 9 years and has been negligent enough not to notice you owe them for 9 years, they don't deserve the money.
My advise.... take the paper in both hands and rotate them in different directions. then find a waste paper basket and aim! |

Most of the time when it is that old...they will accept about 50% of the amount due, if you can pay it all at one time. |
