I have a payday loan for $185 that is a week overdue in Louisiana. I called and said I could pay it Friday, but she seems unwilling to work with me.I can pay off this loan, but I got into a car accident and can't get there til Friday. In result of loosing my car, I lost my job. I can still pay it off but on Friday though instead of right now. So I had to write a post dated check to take out this loan and the lady hasn't even tryed cashing it. She said she isn't going to go to jail for cashing a bad check. She also said that she is sending my check to the sherriffs office telling them it's a bad check, when she didn't even cash it and wont work with me on paying it off. Then she told me I could speak to a manager and I asked her then if I could. Her response was she was the manager. I'm not sure what to do here. I can pay it off friday, and still plan to but will the cops come before I do? Can the cops even come for that? |

When you took out this payday loan, did you write a post dated check? Usually a payday lender has you write the date you took out the loan, not the date it is due. Also, if you do not come in to pay off your loan or the fees, they typically will deposit your check or try to do an automatic debit to your checking account. They very rarely sit on a check waiting for you to come in and make good on it. That's why a lot of people get into hot water with payday loans. The payday lender cashes their check on the day the loan is due regardless if you show up to pay in cash. This usually leads to a lot of overdraft fees for the borrower.
If you can pay this off Friday, go in on Friday ( is this a payday lender with a storefront? ) and pay it off. If you wrote them post dated checks, be sure to get those back. You also may now be on a list that will ban you from getting any payday loans. Thing is, if you are unemployed, that isn't going to be a choice for you anyways.
The thing you have to remember too, is, since you didn't pay the loan back on the day it was due, there are going to be some additional charges/interest/fees. You need to read the contract you signed to see what you may be charged. I guarantee they are going to want more than that $185. |
