It depends on your State laws but not much bad will happen to you- there are no pauper prisons anymore. (It's sue, not sew)

If a constable has not physically served you then you may not be getting sued... yet.

Collectors are creative individuals and if you were told over the phone that papers have been filed or that you are going to be sued, it may not be true.

In addition, if it was a collection agent with a collection agency that relayed this information to you, he may be in violation of the Fair Debt Collection Practices Act. This is the law that governs collection agencies and their collection agents.

Under this Act, a collection agent may not engage in harassment or abusive tactics or make statements that are not true.

It is important that you address your credit situation. However, you may be under some undue stress.

If you are unemployed and have no assets, your credit record would reflect this and the creditor and/or collection agency would be aware of this information. Hence, making you a bad candidate for a lawsuit. Lawsuits cost money and they are not going to spend money on suing someone that has nothing of monetary value to take.

Do not get cornered and apply for a loan or liquidate what little assets that you may have to make payment. Rather submit a written letter explaining your dire situation and that you will make restitution as quickly as possible. Verbalizing this over the phone will have little effect, so it is important that you send your letter Certified Mail-Return Receipt Requested.

Then get aggressive in finding a job that gives you income. A second job may be necessary, at least until you get your credit situation under control.

Get a job even if you have to go to the temps. Then go into court with a payment plan all mapped out. Have the first payment when you go there. The judge will agree to your payment plan most of the time.

Whew, Jamie G. This is a tough one to answer. You didn't say what state you live in. Most states have "garnishment laws" whereby your paycheck can be "garnished" (attached by the creditor and a portion of it claimed to be paid to them for the debt). Obviously, if you are unemployed, they can't garnish your wages until you find one, but that alone can cause problems in finding a job. If it's a credit card company that is after you then that means you don't have anything securing the debt such as a car or furniture that they can repossess, so that's good. If you happen to live in Texas, garnishments aren't allowed so all they can do is screw up your credit which you say is already screwed up, so not much can happen to you. I would suggest you go back to your question and add the state in which you live so someone more familiar with your particular state laws can give you a better answer.

Bankruptcy on $3000 in debt?? NO, in my opinion.
If you have been served, don't miss the court date. A default judgment could occur.
Every state is different and no advice should be given on what exactly can happen to you. No one can know with the information you have given.
The companies want the money owed. Many time, payment plans or other options could be available. But again, no specific advise could be given. Just do not miss a court date if one has been set.

the best thing that i can think of is go to a credit council. They are suppose to be a non-profit, so they should not charge you to talk to you what your options are. They will work with the credit card company to reduce your payment & interest rate.

Bad credit is one of the worst problems to have... however there exists a solution.

I will hereby talk from my personal experience.

I did debt consolidation a couple of years ago, however If I had to do it again I would pay to some minor details,
if someone wants to get out of debt today it is pretty easy with a debt consolidation plan, however it may get a bit tricky at times, I suggest you get as much information as possible online on this first,

You might consider bankruptcy if you do not own a home that would complicate the issue. A public record such as this does not look good on your credit and can cause issues for years to come. If you qualify for bankruptcy, you may have a chance at starting over to rebuild your credit. The first steps would include pulling a copy of your credit report, then speaking with a bankruptcy attorney. Do this as soon as possible.
