Domonique | I have really bad credit but my husband has excellent credit, a few creditors called? |
and said that they would put a lean on my husbands house (its only in his name) would it be best for me to bankrupt $20,000? |

First of all they can't lien the home. It's not yours. But you do need to take your financial responsibilities seriously. Better make arrangements to pay off your debt. Good luck. |

I would check into this more in depth. The house might be untouchable since its your debt. Did your husband have the property prior to your marriage? In some states, property/assets obtained before marriage belongs to the sole individual and only property acquired during the union is joint. With that being said - I don't know if the creditor can rightfully place a lien on his property if he had it before he had you. Now if the house was acquired after marriage and bares only his name - then there is a possibility for a lien to be executed. Check on the laws of your state.
Creditors are not above saying anything and everything to put fear in a person so check further into this issue. And perhaps try working out a repayment plan to get this debt resolved. But remember whatever you do from this moment forth - try to do it all in writing. If the creditor agrees to a term of repayment...get it in writing. |

Don't get involved in phone discussions, especially where large amounts of money are involved. Any legit place, or collections agency, will communicate the issues in writing to you. |

Try to settle with them if you think you can pay. Can you take a loan on your house (secondary loan) and pay the Creditors. |

You can file bankruptcy separate from your husband only if the bills were incurred before the marriage. Otherwise, you will both have to file and you will ruin his credit also. Talk to a bankruptcy lawyer and see what advice he/she gives about filing. I'm not sure if they can put a lien on your house, but the lawyer can answer that question also. |

I don't think that they can put a lien against real-estate. But the laws vary from state to state. |

Bankruptcy is a coward's way out of obligations you took the responsibility for when you incurred the debt.
This is another pitfall of the marriages where there are "HIS" and "HER" bank accounts. For God's sake, you're married and in this thing together. You should both work to pay off this debt and forget about looking for ways to skip out of it.
Go to a credit manager where they will teach you how to budget and be responsible with your finances.
This is no way to earn 10 points but it needed to be said. |

When you are married, so are your finances. Though the house is only in his name, your credit histories are linked. You should seek help from a credit counselor who can talk you through what options might be available for you, maybe even a debt management plan. |
