Owe your obligations. Try to sell the car to pay off the loan. Bank will repossess your car, and come back for the rest. Your credit will be ruined, you will have difficulty getting a loan again.
It is immoral not to repay a loan.

At some point, they will reposess the car. If they sell it for less than the amount owed, they come after you for that, just like any other unpaid bill. Meanwhile, your credit is trashed for years.

As per the agreement that you have entered into, at the time of availing the loan, the loan amount has to be paid in full and final to the bank.

It is mentioned that your son has given the car to his friend who is not able to pay the installments.

If that is understood as a sale of vehicle to your son's friend it would be VOID AB INITIO ( Void from beginning) - means how can you sell the vehicle to which you are not the owner.


In case of vehicle finance, the bank will be the owner of the vehicle and you shall be mere user.

Depending upon the finance co, that has given you the auto loan, after 2-3 regular defaults, the recovery team shall identify the vehicle and the vehicle will be seized,

Since, the fault is on your side, nothing could be done. At a given date the bank shall inform the auction of your vehicle in the premises.


With the proceedings of the vehicle auction, the bank shall settle the loan amount that is due from you. If the auction earns more than the loan amount, the excess amount shall be refunded. Other ways, if the auction amount does not meet the outstanding obligation, the balance shall be recovered from you.

Are you naive? A loan is given by a bank under a legal contract. So the bank would issue a notice to you, if it is courteous and not like some Banks which engage loan recovering agents (read goondas). In the former case you land in a court in long litigations (the lawyer draws out your money first before appearing in the courtroom) and finally end up in a jail whereas in the latter you may end up being a mental wreck if not physically assaulted.
Better would be to approach the bank forthwith and try to reschedule the payment plan. Your son's friend has no role to play, he will enjoy your son's foolishness unless he is the guarantor. To bring him to book file a loan recovery case against him in a local court right away. He can not escape if he has paid those 20 installments to your son by cheques.
