It was just last year ago, March 06' when marketers offered me a getaway trip. Then i decided to cancel it after 4 days. Until then they were having problems refunding me the money. My bank disputed several times now, and until now the merchant hasnt refunded me the money- all they tell me is that they are pending and its at the "faith period". Im stuck and i dont know what to do? I tried contacting the merchant but their service is not available. I tried e-mailing them for a confirmation number but no reply. Why is it taking so long?? Ive had enough and i dont know what to do. Should i file it to court.??? |

If you can, name the company, and the owners or managers on the suit and hold them as co-defendants.
Chances are you will get a quicker reply when you make it personal with them. |

Call your State Attorney General's office today. Explain to them what has happened. If nothing comes of that you can file a small claims action against them (usually the ceiling is about $5K) and the cost to you is minimal.
Since they won't want to send an attorney to your local area to represent them in your claim against them they will probably pay. Barring that the judge will likely award you your amount in full as requested since they "failed to appear" in court. This is almost always the case.
However, the real question still comes. How do you get your money back? Because even though the Judge agreed with you in your claim the company still has to pay. It may be a little more difficult but I like to go for the throat on such things.
If you can present to the Judge specific assets that the company owns which can be collateralized (seized and sold at auction) in return for the amount they seem to owe you then the Judge can attach a lien to those assets. Examples: cars, real estate.
What happens in this case is that law enforcement will have those assets seized and auctioned and you get the money. If you go for the throat (like me) you can be driving around in the company CEO's car by buying it at auction and then selling it for a profit. Being legal pays! |

If you have all the paperwork, and have documentation that you have requested the refund several times and haven't received the refund, I would take this matter to an attorney who handles small claims. |

the heck would you want to put any money out ther if you dont
even know it is a scam there are lots of scams out there and
what a better way to do it in as a tele marketer to swindle you
out of money you need to say no nothing comes for free |

You can try contacting the Better Business Bureau (or your state's Attorney General's Office if you are in the U.S.). File a complaint and see if they can help you get your money back.

(By the way, NEVER go on one of those trips where you stay a couple of nights free and *all* you have to do is listen to a 90 or 120 minute presentation!!! I fell for it earlier this year and it was FOUR HOURS before these people would let us leave!!! It was a NIGHTMARE!) |

Could be fraud. I would find our some more phone numbers and KEEP CALLING. Get a lawyer if necessary for advice. The lawyer could simply help you construct a letter telling them that if they don't return your money that you will have to report them to the better business bureau and you will be taking them to court. Many time this will scare them enough to take action.
Part of the reason why they are inclined to take action quickly is in some states after informing the company 3 times you can collect double damages in court. Make sure and correspondence you have with them at this point is either by certified mail or e-mail. Basically something that can be documented and used in court if necessary. good luck |
