I need to know if this is Credit card fraud or not?
I have a sort-of-relative who came up with the idea to withdraw the maximum allowable amount of cash- somewhere around $12,000 from his mother in law's credit card, he got his wife to do it, the thing is, is that his mother in law is 99 years old and not expected to live much longer. So he makes the minimum payments on the card knowing he will be left with the majority of the cash when she dies. Is this legal? Because I find it horrible and would love to blow him in. I can see where it's not illegal to withdraw the money so long as to pay what's required, but his intent is obvious. I'm not sure if He (his wife) had the permission of the mother, but even if they didn't, she is too out of it to realize what's going on.

Its not only illegal its a felony and he and his wife can go to jail for a very long time and you need too turn him in and stay away from him or you will also be chaarged with guilt by association.

It's not right... but in my opinion that's fraud. I'd turn them in. That's a shame that they are taking advantage of her like that. Her debts will be up to him to pay as well.

He is intentionally taking money that doesn't belong to him, knowing that the company will write it off when she passes. If I were you, I'd turn him into the company and to the cops, and the IRS.

If only because it's immoral and he shouldn't be doing it in the first place.

It's people like that who cause the rest of us to pay outrageous interest rates.

I would stay away from them you might tell one of the old lady's close relatives. since you know about it and are not telling someone who could do something about it, you are guilty,. if not in the eyes of the law which I am not sure about but probably it is against the law. ask your self, what would Jesus do?

Not legal living or dead. Someone will find out because $12000 in one transaction is a red flag w/ credit card companies. Why would someone do that to a family member for one and one who is that old? Its cruel and if they had waited till she passed who knows maybe some inheritance would be coming their way anyway. They are ruining her credit and its considered stealing because your family members ripped her off. Turn them in!

If the owner of the card did not give Power of Attorney to the daughter then this is elderly financial abuse. The problem that you will face is that you will have to be able to prove that none of the proceeds from the withdrawl where used to care for or buy for the card owner. also if the card does not have a life insurance clause on it there would be no fraud since the debt will become part of the estate of the deceased and the credit card company can actually go after teh family of the card holder to get their money. if there is an insurance policy on the card balance then it is both elderly financial abuse ( for depriving the card holder of her available credit or funds) and insurance fraud ( for knowingly and willing attempting to use the insurance money to cover a debt that was made for the sole purpose of having the insurance pay it) you can turn these people in to the credit card company or the attorney generals office in your state. You will have to give a statement and possibley testify to this in order for the attorney general to prosecute.

If he did not have permission and he took the money out of her account, someone had to sign for it because no ATM is going to hand out that much cash. Yes, it is fraud and it is a low down kind of fraud. What if he is not the beneficiary it would serve him right. He knew it was wrong, that is why he got his wife to do it....so she goes to jail instead of him.....what a pig! It is not legal for him or for his wife. What is wrong with people out there, man oh man? The Mother being too out of it is what they are counting on, and the way he sounds He probably won't pay off the card either when she dies and just notify the insurance company she died and send a copy of the death certificate. That could backfire on him though because the credit card company can put sort of like a lien on the account which would mess up her Will in Probate Court and they will ask for all the money at once. If there are other family members they will find out then. Someone needs to turn him in for real......but of course her picture is on the cameras wherever they got the money or check cashed. What a loser! Another case where when others commit fraud be it insurance fraud, credit card fraud, etc, which ends up costing consumers higher premiums or interest rates. AND, then we citizens have to pay more taxes to pay for their prison sentence as well. One other thing I forgot about untill I read the other posts here, everyone is right, especially now that you wrote about it on here. You now have no choice other than to report this to somone of authority, You are aware of this crime and can be considered an accomplice to a crime since you knew about it and did nothing. If you haven't noticed there are all kinds of people on this site like police, retired judges or they say they are retired....one call to one of their friends and????? Reading what you wrote about this guy has really angered me. I can imagine if I were a Judge or FBI or Policeman what I would do....contacting yahoo for your name would be the first thing. If you know whats the credit card company and more identifiable information you should go right ahead and call them and report the fraud!... Let them know you want to remain unanimous and let them take care of the rest.

Yes, this is credit card fraud. It will probably never be able to be proven especially if him and his wife have power of attorney over her finacial affairs - then it would not be credt card fraud but they will be responsible for her bills when she passes if they have this poa. Too bad people are always looking for the easy way out and honesty and integrity are words to be looked up in a dictionary now days! That is why the interest rates are going up all the time - to keep up with the cheats and the frauds in the world!

That is absolutely sick that he is trying to make money off of his wife's dying mother. He is also putting himself and his wife in danger if that is a fraud. Do the right thing, man.

I'm not sure about the legal specifics...but that sounds like it is probably illegal. I doubt that this woman agreed to him doing this. On the bright side, I'm sure that activity like that is not normal on her account and the card company will probably contact her to find out if the charge is fraudulent.

The real tragedy here is that a credit card company is giving credit to 99 year old's. Stealing is wrong but when you give credit to people who obviously can not pay it back at high interest isn't that loan sharking. Its fraud but it also stupid to give someone access to that kind of money on their death bed based probably on a good fico score.
