...There is a Law called the Fair Debt Collections Act... when this guy calls you (and he's NOT a police-officer...cops don't collect debts...collection agency's do)... Ask his name and the name of the company he works for... "tell" him that under the provisions of the Fair Debt Collections Act as amended you are demanding that "they" do NOT call any more... remind "him" that "they" can write you at your address but if "he" continues to call, you will report "them" to the Attorney Generals office and place their Company in violation of Federal Law... ask him... "sir, do you understand what I';I've just said to you"...? Wait for a response... take notes... get his name, note the date and time and bid him "good bye"... If "they" call again... remind them of the F.D.C.A. and that you now are reporting them to the Attorney General... and you can.... they can write you... but not call if you demand it to stop... (now... pay your debt... that's the bottom line, right ?) |

Police shouldn't even be involved. Know your rights... look up collection laws for your state and federal collection laws as well. If the company you owe money to breaks a law you can report it.
Don't ever let a collector tell you that you could lose your job over a debt... that is FALSE. Also, as long as you make an effort to pay (no matter how little you send a month) most judges will NOT rule against you in court. |

Here's what happened:
The company you owe money to sold the debt to a collection agency. The person calling you works for that collection agency - they get their money through intimidation and scare tactics.
If they are calling you at work, that is most likely illegal. Since this person IS NOT a police officer ( you are correct in guessing that police officers do not get involved in private financial matter like this), you can call the police to report him. What he is doing is harassment.
Get caller ID if you don't have it, and don't take his calls. These people can be very scary, very threatening - that's how they get their investment back. |

Cops do not do debt collection. I dont know if you can actually go to jail for this, depends on if your state has debtors prison. I know mine does not.
Typically, if you are trying to pay they will work with you. By law, if you send this "detective" a certified letter asking him to leave you alone and stating that you will work with the debtee, they have to leave you alone, though they may still proceed with taking you to court if it goes that far.
There are so many laws regarding debt collection. They are not allowed to physically threaten you. Do some searching on the internet to find out laws about your state. A good place to start would be the web page for your state. |

I would contact the person you owe and make some arrangement to pay. It sounds like the person who is harassing you is a bill collector who gets a percentage of what you owe if he collects the bill. The person you owe has probably hired him, or he mighy just be a friend of the person you owe. I am quite sure that he is not a police officer. I would pay the person I owe, not the bill collector. |

Arrests for not paying child support, traffic tickets, parking tickets, or taxes are common. Arrests for theft of services (receiving something and not paying) are relatively rare. You cannot be arrested for not repaying loans, such as credit cards or mortgages, unless there is fraud or something else that you have not mentioned, and it is illegal for a debt collector to threaten to take any illegal act, including arrest for debts for which arrest is not possible.
If he has said only "detective" and not "police officer", then he is a private detective and not a police officer.
If he has said that he is a police officer, ask his name and which police department (city, county, or state), including which location, if it has more than one. Call that police department (at the 7-digit number in the phone book, not 911 [which is only for emergencies] and not a number that he gives you [which could be for a friend of his]) and ask to talk to him. If he answers, he is a police officer (probably). If not, ask if he works for them. If they tell you that they do not give out the information, just say that you suspect him of impersonating a police officer and see what happens. If they arrest him, so much the better. |

No the police do not collect debts and he is not a true detective. He is trying to scare you into giving up the money. This is a debt collector using deception in order to intimidate you. They cannot by law harras you at work.
You cannot be thrown into jail for debt. Unless you committed fraud or some other crime to incur the debt. They can sue you and garnish your wages but they cannot throw you in jail.
This bozo is some debt collection agent. Ask him for the name of his collection agency, a proper mailing address, and an account number. If he cannot provide you with these, then tell him until he can provide you with this information you will not make any moves to payoff the debt.
Notify him that you will be speaking with an attorney regarding his harrassment and that you are considering filing for Bankruptcy.
Often times these debt collection agencies will buy debt off of companies for pennies on the dollar. This means if you owe a company $3000 and this compnay buys this debt for $500.00 then every penny they collect over that $500.00 is pure profit.
Offer a cheaper settlement! Offer to pay them $125.00 a month for one year and then they consider it paid in full. Most companies will take a settlment offer or a payment plan.
It is pretty easy to get these people so angry they scream and yell and have fits. I actually enjoy doing this to these people when ever I have a friend who gets a call. Hell start asking him about his personal life....and how it must suck to be so low that he has to call people and lie and threaten them them for cash. Suggest that he get a real job! |

Its not a police officer. It is illegal for debt collectors to do threaten you.
They are trying to get to your emotions... and it is working. Next time they call them them not to be rude, and you will not talk to them if they threaten you. Then hang up the phone.
You could be SUED, but they can not arrest you.
Try to scrape up $1200 bucks and offer it to them as a settlement in full. If they agree, get it in writing before you send them a check. |

A real police detective does not call you on the phone to try to collect debts. A real police detective comes to your home, or work place, in person, shows you identification police badge, asks you questions, tries to take you to police station, may arrest you.
The person who is calling you on the phone should be told that you are not interested in their calls, to please stop calling you or you will call the real police and have them charged with being a stalker.
Let's suppose you had a car that was totalled in an accident. The owner of the car had had an obligation to have insurance to pay for this. Did you fail to have such insurance?
Let's suppose you were paying some bank or financial lending institution installments to either buy the car, or borrow money on it. Any letgitimate car loan company insists that the car owner have insurance of the kind I described above, and to provide proof that such insurance exists. Did you or did you not provide such proof, or did they fail to ask for it?
Sounds to me like your financial loan was not from a legiitmate competent financial institution that knows to aks for proper insurance, so either you borrowed money from the mafia, which will be around to break your legs pretty soon, or this question from you is more theoretical than rooted in the real world.
It the debt is legitimate, the institution can go to a judge and have your employer garnish your wages. This happens all the time with legiimate debts. Let's suppose you are earning $ 7.50 an hour ... what will happen is you will get to keep $ 2.50 an hour paycheck, with the other 2/3 of your pay going directly to the repo place. The government has some minimum money that you are to get, below minimum wage, after the deductions to the repo place.
You should not lose your job over this, because it is something that happens to tons of people. However, it can lead to you not being able to pay for other things, such as rent, food on table, etc. |
