I owe a couple thousand dollars on a couple credit cards, I lost my job and cannot pay them..not now,anyways..
..what, if anything, can these credit card companies do to me in the event I don't pay them? I have heard that since they are unsecured,signature type loans, they cannot do anything except ruin your credit..is this true?? I'm not saying this will work every time, but I have seen it work. Hand wright a letter to the CC and let the know your current situation. They completely understand you have to have a roof over your head and feed your children. The key is to get them to feel sorry for you. You will wan to ask if you have any options and if there is any programs they have for your current situation. Your goal will be for them to freeze your account and prevent at least being gouged with legal and interest fees If you get the right person you can receive as much as 180 days payment deferment

Contact the companies about the issue. Explain your situation. After that, ask THEM what arrangements can be made, make sure that you make clear you DO want to pay back what you owe, it's simply the current circumstance that's preventing it, and you're working on correcting it. Many companies have something called Economic Hardship Deferment, which basically means they'll let you slide for around 6 months without making a payment. Not all have this though, and you'll probably be less likely to get it (assuming they have it) if you just flat out ask for it. Tell them what they want to hear (that you want to give them what you owe them), and you're more likely to hear something you want to hear.

A couple thousand is a pittance, and they will generally do no more than harassing you and threatening you.

Search-up "Fair Debt Collection Practices Act" and read it. Get a copy and keep it handy.

Write them a letter - certified - and tell them you need a plan to get on. 80%+ of them will reply be being horribly nasty. Just keep good records of all this. Put a recorder on your phone and record all calls.

You stay calm and tell them your situation. AS SOON as they turn ugly, write another cert letter and tell them 'cease contact'. They will break that - tape record them and save the tapes.

Then, send another letter (certified), informing them of their violation of Federal law. Write a formal complaint to the FTC about their activities.

They will probably do it yet again. When they do that, they'll be guilty of "witness tampering" and that's a felony. Tape record that one, and then send a letter (certified) to them, informing them they're guilty of "witness indimidation" and that you're reporting every contact as such.

They'll then hand the thing off to a collection agency, and you get to start over - and over - and over...

This dance can go on for YEARS, but they're unlikely to ever actually sue you - at least not for a long time. Then, if they do, you counter-claim them for the illegal harassment - for which they will have zero defense if you've made your tapes and notes properly, and stored them carefully.

They'll either settle or you may even win a judgment agains them.

But, most likely, they'll only harass you as much as you'll let them.

Try calling or writing to them and ask if you can pay interest only minimum amount on the cards for a while. Explain your situation and intentions to them.

Ruining your credit is a big thing. If you move to an area with different utility companies they will run a credit check and not permit you to have service. If you ever want to get a loan for a car or a house you are shafted with bad credit.

Look up credit counseling services in your area TODAY!!! Trust me... having messed up credit is nothing to joke about. Once you start missing payments, that negative info stays on your credit report for 7 years! You can be denied loans, mortgages, apartment leases, even jobs if you have bad credit. And if you do get a loan.... you will be paying really high interest rates.

A reputable credit counseling service will work on your behalf for a small fee (they are non-profts, not FREE... they have to make a little money). They might charge you $5 or $10 a month, but they will negotiate on your behalf with your creditors and get your payments reduced.

If you want to try to do it yourself, then call you CC companies NOW and explain your situation and try to work out a payment plan. If you do nothing and just start skipping payments, then it will be worse for you in the long run. If you made an effort to work with your creditors, that will reflect better on you in the future when you apply for loans.

Also, immeditately start cutting out non-essential expenditures.... no more Starbucks, no more booze, no more cigs.... if you can cancel your cable service do it and save the money. No more Cosmo or Glamour magazine, no BK, KFC or Mickey D's. Clip coupons, shop sales..... make friends with Chef Boyardee. Do what you gotta do to make some sort of payment on these cards.

Call each of your credit card companies and work out a plan with them. They are usually very understanding and will help you out. Any payment is better than no payment. I had to learn this the hard way. Don't ruin your credit if you can avoid it. Send them $25 a month or anything you can spare.

But seriously, give them a call and explain your situation. See what they can do to help you.

I hope your situation improves.

Do everything you can to find another job. If you have to, move to another part of the country that is more prosperous.

A couple of thousands dollar isn't worth damaging your credit. Also, if you pay a bill late it will wreck your credit.

You may want to call the credit card companies and ask if you can skip making payments for a month.

The credit card companies could sue you and garnish you wages. You would have to repay your debts, plus interest, penaties and any legal fees that are incurred.

They will eventually turn them over to a collection agency, which in turn will seek a court judgement against you. When they win the court judgement, they can come after all of your tax returns, bank accounts and garnish your wages when you do start working.

I just had this happen to me, and my tax returns this year all go right to them per court order. I will never see the check. It goes right from the IRS to the creditor.

You may try to call the credit companies to see if there is any help before this happens. Also, yes it will destroy your credit.

Get signed up with several temp agencies to keep you working while also applying for permanent positions.

See if you can get unemployment compensation immediately and job referrals from the unemployment office as well.

Call the Social Services Office in the County where you live and see if they can assist you with rent and utilities for 30 days plus food for 6-12 months.

Call Catholic Charities they offer rental assistance.

Call the Salvation Army, they offer rent assistance.

Call local churches, most of them have a food program or know of them.

Call your utility company and ask about programs to assist you with your payments temporarily.

Call your creditors immediately and ask about programs for temporary hardships (deferred payments etc). Keep in touch with them about your situation. The more strength of character you show them, the easier it will be to get them to help you.

The extension of credit is based on character and capacity. Your capacity to pay is diminished but your character should never be in question in terms of willingness to repay the debt.
