The can't just take money out of your checking account. But, if your state allows it, they could take money out of your paycheck (garnishment). And the only way they could do that is if there is a court order against you, and your state allows garnishment. You have to be seriously past due to get to that point.
If you open the checking account at the same bank where you owe the credit cards, they could possibly take your money from the checking account, depending on terms and agreements you made with the bank. Some banks include terms that allow them to use any assets you have on deposit with the bank to satisfy any debt you have with them. They would only do this if you were seriously past due. |

Some states allow garnishment for unsecured debit after executing a judgement for non payment; but that's a long way down the line, and you'll have plenty of notice and chance to get caught up |

no they can not. however, if the cc wish to - they can forward your monies owed to a collection agency...usually one from within the dept. then it will go to an outside company. if the debt is substantial and they have tried numerous times to get into contact with you and you still evade them; they can then apply to garnish your wages through court, then you have no control on how much they can get minus your allowable living expenses till the debt is paid. the other thing is your credit report will show negative and may impact your future accounts including opening new checking accounts. this will continue to haunt you for the next 6 or so years. the best thing you can do is show initiative and responsibility and contact those cc's and do whats called 'repayment terms' if you agree to them that you will pay x amount each month and don't miss a payment it looks better on your report that everyone can see . if they refuse to do terms with you ..you may have to wait till it goes to collections. but total avoidance of paying off debts not only hurts you now it hurts your future. i have come out of consolidation and bankruptcy. i had a hard time rebuilding and i still have a few more years of "bad luck" to go. i pay high interest on my cc's and my car loan i don't own my own home yet and im still paying on my student loans that couldn't be included in the bankrupcy. |

2) They sue you for the amount you owe
3) They win (the judge rules in their favor)
4) You still do not pay, and
5) The judge issues an order allowing them the seize the checking account to satisfy the judgment |
