My car was repossessed and sold in Aug 2007. The bank has been calling me nonstop since then. Just recently they have left a voicemail that I need to settle the debt or they will pursue other collection options. Are they bluffing or do I need to take their offer to settle to avoid possibly garnishing of my wages? |

Auto finance is what I do for a living and believe me for $9,000.00 they are not bluffing.
If you don't settle they can take you to court and get a judgment, at that point they can attach bank accounts, garnish wages (if your State allows it) and file liens on any other property you may own like cars, boats, land and homes.
All of this will show on your credit for the next 7-years making it very hard to get any other types of loans without making massive down payments, paying huge fees and State maximum interest rates. |

You need to talk to them, to find out what is going on, if they sold your car, you will need to know what they sold it for, and then I think you will have to pay the difference. But you need to talk to them. Also go to the legal aide society or a lawyer to ask them what are your options in this matter. |

First the bank has to take you to court and recieve a Judgement agains't you.Once they do this and they will they can garnish your wages.How ever your first step should be to contact the bank and find out what they sold the car for and what expences were incurred by them for doing this.Next you make a deal with them to pay the difference.as of now on your credit report it willl show as an unpaid account and you will never be able to borrow money again.By doing it my way your credit report wil say account settled and you may once again borrow money when you feel that employment has improved to the point where you could repay a loan. |

First if the bank contacted you by mail with the auction details(amount your car sold for on what date etc...) you are responsible for paying the amount left after the auction. The only way that I have found to avoid paying is #1 Bankruptcy and #2 if the bank has turned it over to a collection agency they will have to provide documentation showing the agreement between you and them for the amount you say is still owed. With the economy being as bad as it is right now the banks have faced lots of repo's lately so I'm not sure how they will respond right now. Do they have the law on their side as far as garnishment,,,,sorry but yes. But most of the time they will bug you to death for a while and then sell off your account to a collection agency and they will start bugging you to death. Good Luck hope this helps. |

What state do you live in? Not all states allow wage garnishments. Not to mention that a creditor can't garnish wages without a court-entered judgment, meaning, that they would have to file a law suit against you and then win before they could even begin to think about going after any of your assets.
Most likely, the bank was making reference to them giving the account to an attorney so that a law suit can be filed.
I would suggest that you contact an attorney. You can get a referral from your local county bar association and you might be eligible for free legal help from your local legal aid office. |

Settle. Not only can they garnish your wages, they can also attach to any other property that you own outright. So, if you have another vehicle without a lien, they can basically take it from you and auction it off to help pay your debt. |
