well, the chances are not good, factor in the cost of traveling and taking time off work to go to court and it just might be easier to take a loss.

If they filed a chapter 7 theres really nothing you can do because I'm sure that this is an unsecure loan. If they filed a chapter 13 you should received a proof of claim. fill this out and submit a copy of the loan, hopefully a promisary note to it. Granted it is an unsecure loan but if there is any money left in the 13 they will disburst to all unsecure loans that submit a proof of claim

I'm a little confused over what you are claiming....you bought furniture from them? Does that mean they didn't send it to you and kept the money?

Either way, you always file a claim. The notice that you received should have been accompanied by a claim form. Send that form plus whatever proof you have to support your claim to the court/trustee.

There are two reasons you need to send in this form. If it's a Chapter 11 or 13 you may be entitled to receive something (it won't be a lot though). If it's Chapter 7 you won't receive anything at all.

But you are now on their list to be informed of developments. If their BK is dismissed, you will be notified so you can pursue collections again. Otherwise you won't have a clue what is going on.

Do not waste your time attending. Unless you have a very good claim, or can prove fraud, you will just be wasting your time. I've attended many, may of the creditor meetings and in nearly every case none of the creditors attend. In cases where there may be an objection, the creditor has already contacted the attorney or trustee, and the corrections are being made. Very rarely will you have a good enough case to get the bankruptcy tossed out.

Just be glad you only got stiffed for $1200. It could have been a lot worse.

There should be instructions on that letter how to send in a objection to the BK by mail. So you should not have to go there.

It depends on the assets of the company as to if you are going to ever see anything from it. However, in general consumers are the lowest priority and the trustee will pay other creditors before they even consider the consumer claims. Not to say you won't get any back, but it is defiantly not worth spending any more money to get to another state to object to it.

If they filed for bankruptcy Liquidation, chance are you will get zip.

You can go to the hearing and tell the judge you are a creditor in the case. In a BK, employees and IRS are paid first, then creditors. If there are no net assets, it will be a loss.

If you paid via Pal Pal, check to see if the seller had Pay Pal protection. You might be able to get that insurance for non-receipt.

You can also file a non-receipt claim and expedite it immediately to Pay Pal and they might be able to reverse the payment, thus get your money back. Hurry!

Bankruptcy law is a federal law, not state.

All you have to do is to file a Proof of Claim when the bankruptcy court tells you to. It is probably not worth your time/money to goto the creditors' meeting. Basically, you just have to wait for the bankruptcy to be resolved (hopefully it is not a Chapter 9 filing) and wait to get some of your money.

You don't need to go to "the meeting of creditors"- no reason to That is if a creditor wants to fight the bankruptcy filing. They never win. If the person filed a chpt. 7 you will get nothing- if chpt 13 you may get 1% (pretty much nothing). You cannot contact the person who owes you! I wouldn't count on getting paid. Sorry!

I think they changed the laws on bankruptcy...I don't think people can use it to just completely get out of paying bills. Used to people could file bankruptcy and wouldn't be responsible for paying them once they got on their feet. Now I think they have to pay it back.

It probably varies from state to state. You may need to call a lawyer or something.
