I rent a room from someone and I love it but their credit card company is harassing me.?
I rent a room from someone that I know personally. I love living with them and they really need the extra money. So please do not suggested that I just move out. The people that I am living with are having some financial difficulties. THey were both laid off from their job and it took them a few months to find a new one. Their one credit card account was not being payed on time. They are doing the best they can to pay the credit card off. The problme is the company keeps calling me and accusing me of being the card holder. They are giving me very personal information that I should not have. Not only this, they(the credit card company) are screaming at me over the phone and telling me that I am lyier and I am stealing things from the store and they will have me arrested. I have tried to get the persons name that keeps doing this but she will not tell. I get at least 15-20 of these calls while the card holder is not even home. Who can we contact about this issue.

What does *70 do? I need to gain access to their phone number because it comes up unlisted on my caller id and they will not give a name or number once you mention the harrassment they hang up

dont answer the phone when you see it is them.
Get your own line or a cellphone and do not use this phone if is bothering you. YOu might consider taping the calls

If these are collection agencies then when they call again tell them that you are NOT the card holder and if they continue to discuss the debt with you and make threats they are in violation of the Fair Debt Collection Practices Act(FDCPA) and you will advise the actual card holder to file suit against them. Note, this only works with 3rd party agencies. If it is the original creditor then this is not something you can use against them.

The next thing you need to do is have your roommate/landlord send them a certified letter stating that they at to no longer contact them by phone. It won't make the debt go away, but it will stop the calls all together. This is also how they should handle settling the debts, you never talk to a collection agency over the phone. They should only be communicating through the mail(so that there is a paper trail)

Tell the people that call that you are not the card holder you are a tent in their house, and they are breaking Fair Dept Collection Protection Act (FDCPA) rules by giving you this information, if they are calling you on a private line (cell phone or number that only rings in your room) tell them to remove this number from the account and do not call it again.
Also they have to right or authority to threaten arrest, this is also a breach of the FDCPA. They can not threaten with any action they do not have th standing t take.

As for recording the calls, you can do that, but legally YOU MUST let the other person know they are being recorded otherwise it is not admissible in any legal situation (such as being used against them in court)

(for those of you thinking of using this tactic to get out of a debt you legally use, once all avenues of collection are tried, then they can (and in most cases WILL) sue you for the account plus lawyer fess and court costs

Call back and talk to a supervisor. Next time the knuckle dragger calls get his full name, call back and insist on speaking with a supervisor then explain the situation. If it continues get all pertinent contact data from the company and submit a complaint with the FTC.

topdawg gave some good advise until he went on giving his own debt collection bull sh't. I am thinking they have the original creditor calling this is when the debt is 30days to 180 days, they are not protected under the FDPCA. I would recommend the following with this case.
1) call up the phone company and get your phone number changed may cost you 20 bucks or so, but explain that you are getting harassed by creditors.
2) call this credit card company and talk to a supervisor and tell them that you are getting harassed by one of your employees. Even if they are not under the FDCPA they must be ethical. An employee will be face corrective action for this.
3) go to a local sporting good store by a air horn, blast that next time they call. Trust me they will not call again. I had a bill collector calling my roommate and acted like that, did the air horn trick twice. They never called again.

Next time they call, get their name, title, company, address, and phone number before answering any questions. Then tell them they have a case of mistaken identity and you are demanding that they stop calling. Then call your state attorney's general office if they call again.

You could also fool them. Act like you are going to pay, then get the company name phone number and address. Then, very politely, ask for the person's name (tell them it's just so you can write down who you made a payent with). After you have it all, hang up. You can always call back and speak with a manager.
It could also be someone trying to scam you and get your money.

it is not illegal to tape the calls as long you know the tape recorder is yours and you dont have to let the other people know you are taping
