The Lord Therion | If I had some money paid into my bank by accident do I have to pay it back? |
I mean I really don,t have to say one way or another if its even in there If somebody asks do I? |

I would inform the bank, there has obviously been some error. Someone will be relying on that money. Grow a heart and make sure they get it. How would you like it if someone kept your money.

Yes, if the money is not rightfully yours, you have to pay it back. If someone from the bank was to ask you about it, not answering truthfully would be fraud. Depending upon the transaction, there is likely to be a paper trail and when the bank audits its accounts, will most likely be found. Closing the account to avoid paying the money back is also fraud. |

Do the right thing. The error will be figured out pretty quickly during the next bank audit and you can bet that someone else is missing the money. |

You should, they will find out and make you pay it. |

What if the bank made a mistake and took out money from your bank account and you didn't catch the error because you never routinely reconcile your bank statement? They discover their error several weeks later. Would you expect them to replace the money into your account? |
|

Not quite perfect

Yeah, there was a couple that had over $100k (I think) accidentally deposited in their account. They quit their jobs and tried to buy a house, that's when the bank caught the error. Now they're being prosecuted. Not worth it.
What's funny is that the guy was quoted as saying that he thought the extra money was a gift from God or something. |

keeping it is considered theft by deception |

Yes you do. You know it isn't yours, why ask? Many years ago I had a deposit wrongfully credited to my account. I stopped by the bank and told them of the error. I ended up with the same amount credited a second time and a letter apologizing for the first mistake. One more trip to the bank had to be made. |

It's just an accounting error they'll fix, and probably just take the money back out without telling you. So if you spend it, you'll just wind up paying overdraft charges. |
