If I have a debt from 10 years ago,It is not on my credit report..Am I still responsible.Collection called me.
The collection agency also keeps sending something to my moms to get a credit card (some unknown name) of theirs with a payment per month in order to get my credit straight. They said if I call by the end of this week, I will only have to pay 60%%..This sounds kinda fishy to me..

No, it's a scam tactic, companies buy old debts and try to get you to repay them, even though they are no longer any good. Be careful, buy answering them incorrectly, or even by sending a small payment you can revive the whole debt.

If it is not on your credit report, number one, do not send any type of payment or commiment to these people or phonecalls, number two, send a cease and desist letter, let them know you are serious and willing to press the issue with the FCRA and courts if necessary.

Is it really truly your debt? In other words, did you buy something, borrow something, or accept something for which you have not yet paid for?

If so, YES.....you ARE responsible, whether it's on your credit report or not. Be a decent human being and pay your debts!!!!!!! If you don't, you're essentially a liar and a thief.

If not, then don't worry about it, it's a scam.....and they can F*** off.

check your states statute of limitations on collections, usually it is anywhere from 5-7 years, ignore or report them.

If the debt is 10 years old and the account has been charged off from the original credit card company (card account shut down and sold to collection agency) you may not be liable. You need to find out what your state law is regarding this. Most will, after seven years of an account being shut down and into collection, regard that debt as no longer yours. If you had any negative mark on your credit report it drops off after 7 years, bankruptcy is the same. Don't respond to the collection agency, just ignore them and eventually they will stop. If you talk to someone you'll just "stir up" that old "phantom" debt and they'll keep hounding you. But definitely don't pay a dime, you're not liable any more.

Debts established by court judgement are valid in most jurisdictions for ten years, and can be renewed for ten more. If the judgement was not discharged by a bankruptcy, that judgement is still collectable, even if it no longer shows up on a credit report. Most debt collecting outfits give up long before ten years, but some don't.

If this thing is ten years old and you are just starting to get calls about it again, it sounds to me like the judgement was renewed, and some new debt collector has got hold of it. If this is the case, and you never went through a bankruptcy, or did and neglected to list this debt on your schedule, it's a valid debt and you are obligated to pay it. The part about contacting your mother is out-of-bounds on their part, though, and if she sends them a letter threatening to sue if they don't stop - do everything in writing and keep copies, phone calls are nowhere near as effective - I'm sure she'll stop hearing from them.
