No, they can take you to court unless the card or loan had a lean on it. So they should not even ask you. I got a call from a bill collector for my neighbor and that is illegal, so don't listen to them everything must be in writing. When that happens then you go, or sign the court papers not guilty. I just got sent a letter for small claimers quart for a apartment I did not rent or live in. I sent that in not guilty, and also replied I will go after them for misinformation, faults statements, and any time lost for work and emotional damages. I don't know the out come yet but it can take up to 2 years so.

If you have court paper to go - go or send a lawyer. no court papers it never happen. there needs to be a paper trail.

If you don't go the judge will automatically side with the prosecutor. And generally speaking will hit you with the maximum fine because you are wasting the courts time.

If your lawyer represents you than no need to attend, if you don't show up and don't have a lawyer they court will likely rule against you, don't do it!

They can only take you to court after you have been served.

If this has already happened and a court date is set, if you do not show up the court will award whats called a default judgment to the credit card company.

At this point they can attach bank accounts, garnish wages (if your State allows it) and file liens on any property you may own like cars, boats, land and homes.

If you have not been served, they are bluffing. If you have, they are not and it's very serious.

If you not show up, it's mean you admitting your fault. They will transfer your account to collection agency and judgment will show on your credit report. You have to go if you think you can negotiate something with them or you will pay off the the balance. Good Luck!

The very same happened to me, a CC company/ collections agency sued me. I didn't show up to court because I didn't care and I was scared. They wont he default judgment and I was left to pay the judgment and their lawyer fees. I negotiated it down a bit, but it wasn't the same. Go to court, tell the judge your story and see what happens.

By the way they will call you trying to scare you by saying they're sending over the sherriff. Tell him, thank you for letting me know, i'll get coffee started for them.

You have something they want - your money. So you still have the upper hand until you get served the court papers.

FYI - try to make yourself look helpless and unable to afford anything, you should get some compassion out of the judge.

if you owe money why not pay it? call them and work out a deal, a payment plan...

get it in writing before you pay one dime.... do not give them access to your checking account.... running and hiding won't make the problem go away... (I tried that once, at the end of the day it don't work).
