This issue is handled in probate court. The creditors will get first pick of the person's assets...after all accounts are settled, then the money is divided among the heirs. If there is no money to pay off the debt, the family members do not have to pay.

All debts become the responsibility of the estate. Assets have to be liquidated to pay off the debts, before any assets can be passed to heirs. If the estate doesn't have enough assets to pay off the debts, the creditors will have to write off the debts.

Surviving family does not inherit the debt -- no matter what the collector might try to tell you.

It is supposed to come out of the estate.

So lets say you own a house and a car, and some land. But you owe a ton in credit cards. You die and leave your land, home and car to your son. But your son then has to sell your property and use the money to pay your debts. He can only keep what is left over.

However let's say you die and have nothing. YOu own no land, no car, and you aren't leaving your kids a dime. Well then your credit card company cannot sue your kids to make them pay your debt. THey can only take the debt from your own estate. Your stuff will end up being auctioned and they get what they get, if there's nothing left then they are out of luck.

That's the way it was explained to me anyway. They have to pay your debt with your estate. If you have nothing, and leave nothing, it's not an issue.

However it can get complicated if your kids have COSIGNED on things or have their name on joint accounts and stuff.

In a way yes.
They will take it out of their estate. Ex: Their house, car, furniture; everything will have to be sold if there are creditors due.
Family memebers could end up with nothing.
But.... they can not come after family memebers once all the assets of the estate (including all annuities, and stocks), are sold.

It depends if they accept to inherit. They can refuse (for examples, if there are only debts and no inheritance, or more debts than inheritance).

However, both go together.

not necessarily. whoever has money coming has to sue the estate of the dead person. if they do that and there is money in the estate, they may get paid. maybe not

They have to sue the estate it will be up to a probate judge to decide. It is not automatic as many of the poster answer.

Yes, they have to pay the debt. Both your debt obligations and your assets pass on to the next generation. To max out cards for one last spree would be selfish and a real hardship for the inheritors.
