It means that the lawyer is interested in sleeping with your sister and this is a good opertunity to get close to the family.

First, you need to understand that collection lawyers are desperate to take any case. They are usually young, right out of law school with a brand new Bar#. They aren't good enough to be hired by law firms, can't hack public defenders work....so the either take on personal liability cases or collections (very easy work but doesn't pay much).

That said, if this lawyer is local to you, take it seriously. It's no big chore for him to appear in court.

If the lawyer is several hundred miles away, it is most likely our young attorney friend. Unless the debt is huge all you will get from him is threats. Unless he hires a local attorney to appear in court there isn't much he can do. If the debt is small (under $500) it's a guarantee he won't waste his time or money.

It's a gamble....play it carefully.

How do you know it is an attorney? Could be a fraud or scam. One can print a fancy letter head and call themselves an attorney. Check it out on line through the state bar association or call the number or pay the office a visit.

Get all the facts first.

Be careful of scam artists...

he is trying to scare you; I got one too and dealt w/ it through a consumer advocacy foundation.

It means you owe him money.

you need to pay it before they put it on your credit. you won't have to go to court or go to jail over it.

The Fair Debt Collection Practices Act applies to lawyers as well as regular debt collectors. You should have received the following info along with the letter:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.

Demand verification of the debt, and that will cease collection efforts until they provide you with verification.

It means that the person you owe money to is getting serious about the non-payment issue. Is there a reason you aren't paying? Do you really owe the money?
Are you sleepless at night because you are continually worried about the money you owe and think there is no one to help you? Well relax. You can typically get a consultation with a lawyer for free, just to see what your options are. Perhaps the person you owe money to is willing to accept less that what you actually do owe, or payments over time, just to get some money. Maybe if the case is really bad, filing for bankruptcy protection might be the best case as a last resort. One thing that you absolutely don't want to do now that there is a lawyer involved, is lose your cool, call the person you owe money to and make threats, or anything like that. You will note that the lawyer used very nice wording in his letter, and the letter dealt with FACTS. Not issues or emotions. The letter would have signed off with something like, "please reply by such and date or we may take whatever actions necessary to collect the funds owing. Kindly govern yourself accordingly,"

most sincerely.,

You will absolutely note that the lawyer didn't say we will sue you or start legal preceedings against you or report you to the credit bureau, all things that he might do if you
don't make some effort to pay ths money owing. You can't threaten legal action, you can only do it. So please do not just throw this letter out. If you get up getting formally sued, make sure to file a defence with the court. If you don't file a defence after about 14 days typically, the person suing you can claim a default judgement, which means you have lost your case and have a judgement against you, which will go to the credit bureau automatically. You wont even have an opportunity to go to the judge and say but your honour, I paid this person back!!!!

bill, yes just bill
Good Question, when a lawyer sends you a letter about how much you owe. It is an attempt to collect a debt prior to actually suing you. It isn't until you are actually served court papers that you need to immediately hire a lawyer to defend yourself.
