No, but they may raise or lower the amount of support he has to pay based on the householed income. They will consider both incomes if the mother requests a change but only he is legally responsible for the debt.....also, they can take your tax return money if you file jointly as a married couple for any back support or if he is not paying up. |

Depends on the state and if it is back pay or regular child support. They can take your taxes if back child support is owed or if he is suppose to pay a portion of his taxes to child support. |

Garnishments are NON-TRANSFERABLE.
Just because your soon-to-be husband HAS TO BE GARNISHED to fully pay for the child he created with another woman, doesn't mean that you are legally responsible for his obvious immaturity and trifling ways.
You know -- your question smacks of so much foolishness, that I might pose a question for you:
Why the hell do you want to marry a man who can't pay for the babies he creates? I mean, my goodness, if he has to have his pay garnished for his BORN CHILDREN, how he gon' pay for the unborn ones y'all gonna have together?

No they can not, but they can take in effect your wages to come up with the right child support amount. Meaning the could raise it if they wanted to. They entire household is taken into consideration but only taken from his wages. |

YES THEY CAN! Especially in the state of Missouri where I live. You being his wife makes you equally responsible for him pre-marital Debts or obligations. Some states my very so please check with a local attorney before making any decisions. |

I just want to say something. To everyone that says that she's "marrying a man who can't support his babies" needs an awakening! Just because your pay is garnished for child support doesn't mean you are not taking care of your kid right. If I was a guy and had to pay child support I would make sure they garnished my wages. That way you have a clear record of support being paid. Baby mama can't try to say you didn't pay the child support, ever. Its the smart choice. When my husband and I split up, the lawyer gave him the option of having his wages garnished or just sending me a check every month... he and I discussed it, and chose the garnishment to protect BOTH of us. He has no choice but to pay, so my child gets his support, and I can never get mad and try to screw him by saying I never received the child support.
And LarryGreed is sorely mistaken. I live in Missouri and they WILL NOT garnish the wife's check for the husband's child support payments. They will garnish the wife's income tax if they file together, but that is it. There are other garnishments that may affect both parties, but child support is not one of them. The party responsible for the support payments is the only one that pays directly. |
