It all depends on what state you live in.

But here's a breif rundown.

If you are sued and lose, and don't pay...

Then can lien your house, car, bank accounts, wages (most likely) In the state I live in they can take up to 25% of your paycheck.


They could also discharge the debt. This writes if off your books, and you don't have to pay a dime. This is a MAJOR hit on your credit rerpot. Also you will get a 1099 next year, as this will be taxable income. For exapmle lets say the discharge is $25,000, and you make $25,000 a year, you will have to pay taxes on $50,000 for the year the discharge was done.

Well, believe it or not, they can't do much. When they sue you and win, all they have is a judgement on a piece of paper. If the amount they want to collect from you is under $10,000, then you have nothing to worry about. Also, you may want to check what the statute of limitations are in your state. Once your past the statute of limitations, they can't do anything at all, except try to collect from you. Check out www.ihatedebt.com to find your state's statute of limitations.

Depend how much you owe them, and what legal action they had taken. In general, there are the legal action a Credit Card company will take against the card members for failing to settle the outstanding:
1. Status demand;
2. Writ of Seizure;
3. Bankruptcy petition.

When writ of seizure is issued against you, all your properties will be "seized", and they can sell them off to pay off your debt.

Bankruptcy petition is to declare you bankrupt. But the amount you own them must be S$10,000 or more.

I assume you are being sued for a seriously delinquent account? Here's what happens:

Usually they threaten lawsuits more often than they actually file them; but IF they push it, what will happen is that a judge will award a judgment against you. When that happens, they can do things such as put liens on any property you own, or garnish your wages at work.

If things are that bad, you can often settle with the creditor for pennies on the dollar. If you owe them, say, $8000, and you can pay $3000 right now, They might just take it and consider the account settled. Just gotta call and negotiate.

It depends on the amount you owe them. If it's a large amount they may offer a settlement, or they can take you to court and obtain a judgment against you which gives them the power to garnish your wages, levy any bank accounts you have, etc. Why don't you just pay them like any reponsible citizen?

In Singapore, the banks will engage a lawyer to serve you a statutory demand as its 1st step of the bankruptcy proceeding. If you do not pay in 21 days, they will get a court order for a Writ of Seizure. Someone from Supreme Court will go to your house to tag your items such as TV, Hifi, tables chairs, fridge, PC, etc. They can't open your cabinet to tag your clothes or jewelleries. They will give an estimate $ on the items tagged. An auction date will be given thereafter. Try to pay afew thousands to avoid the auction exercise from happening.

If the auction do takes place, 2nd hand dealers will come with the court pple on the said date to bid for your items. If the amount collected from the auction is insufficient to recover the debt, they will proceed to the final bankruptcy stage. You will need to attend a court hearing and they will officially make you a bankrupt and you will have to work with the OA to work out a payment plan.

They can garnish your wages, which sucks big time. Plus they can get you for legal fees so you will owe more than what you were in default for. If it has gotten to this point you might want to consider bankruptcy.

They can get a judgment against you and garnish your wages for the full amount plus court/attorney fees.

Have you actually been served, in person, by the court?

In any case, it is in your best interest to settle... call the law firm tomorrow and cut a deal with them. They will work with you.

You dont want this to go to court if you can help it... either way you will end up paying... but if you can settle before it goes to court, you will pay less.

All of your personal assets are in jeopardy, but usually the judge tries to be reasonable and allow you to schedule payments. If you do not pay - you go to jail. Your wages can be garnished also.
