No. No need to worry about that.

And don't listen to all this ballyhoo about fraud. No self respecting DA would prosecute on that basis. There's no way he could prove intent.....since there was in fact, no intent....hence, no crime.

No one is sentenced to jail time for a debt unless that debt is produced thorugh criminal activity. There are no debtor prisons. Financial obligations are civil matters which are governed by a different set of legal rules. If you are in debt and refuse to pay there are legal methods to compel you to do so, prison is not one of them.

I agree...there is no debtors prison in this country. However, if the debt collectors are after you, they will tell you anything to make you think so. If you tell them you are in bankruptcy they are supposed to leave you alone. Also, either get a cell number, or change you land line two or three times. They eventually go away, because they get paid a commission, they constantly lie to you, and will go after the easier collections. Oh, by the way, usually the bill has been written off before it goes to collections. The collectors buy your name for a percentage, like 45%-20%, and try to collect the whole thing plus fees. All bogus.

No, you would go bankrupt. After that, the government will repo all your belongings. I worked for a credit bureau for a while, and from what I understand, many debts get re-consolidated over and over again from institution to institution. Sometimes nothing gets payed back. Many companies lose money like this. A lot of times these lendors will accept a small percentage (such as 30%) of the original money that was owed. The government makes up for some of the losses. If I am wrong, please correct me.

If they take you to court, there is a court order to pay the debt, and you still don't pay, theoretically you could go to jail for not complying with a court order. I have never heard of it happening to anyone.

OK as far as i know in My state and city NO !

Only way you get put in Jail is to commit a crime to creditors !

Which is kind of hard to do !
The Most they can do is just take you to court and sue you for monies owed !

No but they will continue to call and harrass you.. You could always look @ filing bankruptcy. I would use that as a last resort but it may be necessary unless you want to lose everything you have..The only way they could even threaten to put you in jail is if they were trying to repo your car or something and you wouldn't tell them where it was and they may threaten to file suit on you for hindering a creditor from finding your vehicle.

Yes they can,first the creditors will try to communicate with you to see why you are late in your payments,after that if you do let them know you're out of a job,they might try to work out something but usually in a situation like that at the last minute,it's more reasonable to say that they won't care your situation.They will put you in collection first ,if that doesn't make you pay then the collection will be the one to set aside a court date for you then you can either claim bankrupt or jail time but honestly I dont see why you didnt pay for an insurance that every card has.It usually cost about .80 cents for every $100 dollars you owe and that works for when you are out of a job you call them and let them know ,then they send you paperwork to sign and turn in and they usually give you 6 months that they shut the payments for you till you notify them your employed again,but you should call your credit cards and ask for that insurance and it takes two months to take effect but for those two months you make that payment and after that they stop the payments depending on your creditor the amount of months.
