Debt collectors can take you to court and the judge may put a lien on any or all property you have until the debt is paid. If you do not make the payments set in court, you will have to fork over the property. However, there is a statute of limitations as to how long the creditor has to file suit against you. They may be able to put a lien on your portion of of property or money, depending on what other kind of debt you have, or depending on what state you live in. Debt laws and credit card laws differ from state to state, and if you have other outstanding debt, and your credit rating is "bad" because of outstanding unpaid child support payments, etc., they may need to be paid, first. Consult an attorney. |

This usually takes a Judgement against the debtor (you) issued by the courts. After a judgement is granted, you are fair game. They would call you into court for a disclosure hearing to see what assets you have to satisfy the debt. I would contact a good Credit Counseling Service which are non profit to act on your behalf.

It first depends if your credit card balance has been sent to collections. The creit card company would have to go to court and have a lein placed against your inheritence. |

NO, credit card debit is unsecured debt and they cannot dig into your personal accounts. They can wreck the heck out of your credit history, but that's about it. In order to get garnished, they would need to go through the court system and usually it's not cost effective for them to do so. Garnishments usually take place when you have taken money/credit from a secured loan i.e. house equity loan, car loan, etc. Though I have seen in some cases where the credit card debt was high and tangible property existed and proved that it was purchased with the credit card then garnishment did occur. |
