This does not make sense.
If the credit card company is suing you to recover the money that is owed, then that is a civil matter, and a failure to appear can result in a default judgment being entered against your, but it CANNOT subject you to arrest.
It is possible that the credit card company sought and obtained a criminal action against you, but for that, they would have had to demonstrate fraud, that it, that you obtained the account based on perjured information or that you accepted the extension of credit with the willful intent to never repay the money. If so, then you would more likely have been arrested, not just served with a notice to appear.
Like I said, something here does not make sense. |

call who ever has your info now for the credit card and let them know whats going on but since your getting sued they will want to know why come you have not made a payment on your account. tell them your issue hopefully they will work something out with you (my mom went throught the same thing, her job laid her off and then her mom got very sick and she had to take care of her, so now that she is working she only pays $100.00 a month on it, because she told the jugde that she has other bills to pay like rent,car, and etc so they will settle for $100.00 each month until its paid off.) |

Well, the obvious would be to pay it. If you can't pay it either contact them immediately and come to an agreement to pay it. I'm sure they'd prefer to stay out of court. If not, then go to court and state exactly to the judge whats going on. The judge might break it up. It might be wise to bring your pink slip from you getting fired. If the charges were not from you, you may have figure a way to prove it. Also, you might want to contact a lawyer, I've never heard of a company coming after someone 5 years later, usually they just charge it off. Also, if your in extreme debt, you may want to file bankruptcy and learn from your mistakes and start rebuilding your credit. Good luck! |

I suspect there is more to this story than you are telling. Being sued in civil court does not usually result in a warrant being issued for not showing up.
Anyway, you need to check the statute of limitations for consumer debt in your state. Many states have a 3 year SOL and if your state does you can go to court and have the case thrown out on these grounds.

Go to court, plead your case as to why you didn't pay and why you can't pay now. Take some bank statements with you. You'll be given terms that you can agree with to pay it back.
Otherwise, you will have a warrant out and next time you get stopped for anything you WILL be arrested and, trust me, you do not want to have that happen.
Not going to court would be the first step in majorly messing up your life. |

Go to court--you have too--the credit card company will most likely win--but you can work out payments or something with the judgement--they can't take what you don't have--you aren't really gonna have a choice in the matter--time to face the music~ |

HEY IM IN THE SAME SITUATION < THE ARREST THING , BUT THE SHERRIFF HAS BEEN HERE, and credit card companys cant threating you with jail, thats bs, if you have nothing your like me we could ues the jail time to relax, i too have no job as of may 16 |

so sorry about whats going on. Go to court tell them the truth work out a plan hopefully no interest . A small side note you are not alone this is so common people are losing their homes and many people have bad credit. |

They have up to 3 years to sue you. They might have made a mistake. You should call the court house and ask if the paper work is correct. At least they can not deduct out of your pay, may be get some legal advice from an attorney. There are attorneys that offer free advice. If the dept you owe is more than 3 yrs you may not have to pay at all. |

I think that you should file a despute of your credit file. If that don't work then try bankrupcy. Other then that I don't think theres nothing you can do. See if you can call and work something out with the creditor and make some arrangments. And in the mean time look for another job so if both you and the creditor come to a agreement then you will have the money. |

I'm sorry to hear that! Credit card companies are able to sue anyone who doesn't pay any money they have borrowed from them. It happened to my dad, He went and they agreed on a amount that he could pay. I don't know much about it, Good luck. |

Go to your appt. Usually they'll let you negotiate the amount you owe down or set up a payment plan. Since you don't have a job you could maybe make a deal for your payments not to start for 6 months.
Skipping your appointment would be dumb. Yes, they can do a warrant for your arrest, since technically you "stole" from the credit card company. |

unfortuatly the only real option you have is a use your possesions as collateral and take out a "fast Cash Loan" and pay it off for a while, but its better than going to jail right? |
