Driving-on-E | Is it Illegal? |
I have heard that you can contact creditors and make "pay to remove" arrangements with them by a lot of different sources but when I went to contact the creditor at first the acted as if they never heard of it then I was transfered to a higher up and was told that they cant do that b/c is Illegal for them to do that but based on the several lies that creditors tell to begin with anyway I cant help but to not believe that so is that true and if it isnt how to I go about putting the arrangement in to action and if I have to contact the major credit bureaus I cant find a number anywher to contact them so if you can please provide numbers to where I can speak to live representatives (automated machines are crap) thanks for the help in advance

Man I swear it seams as if clearing up your credit is some big conspiracy and know one wants you to know how to do it or (I'll help just send me $) just my opinoin but it should be free (time, and resources) to fix your credit not a secret |

Yes PFD(pay for delete) letters work. No its not illegal. All collection agencys want there money. If the only way to get it is to delete the info, you better believe there going to do it. You just have to make sure you get it in writing. You might come across a CA that will just ignore or refuse to do it, wait another month and try again. Use letters to ask for a PFD dont talk to them on the phone.
Ignore all the BS you hear from people on here giving lectures about how to be more responible and how its your fault and blah blah blah. 99% of them dont answer the question anyway. When I ask a question here I would like an answer or a place to find the answer not a &%#@ing lecture. Bottom line, who cares if you made mistake with your credit. You just want an answer to a question. |

I've covered this question before. There is NO LAW that prevents a creditor from deleting any item they have placed on your credit report. There is NOTHING in the user agreement with the credit bureau that prevents it either (I know..I've read it).
And yes, the collection agent can negotiate to have an item removed by the original creditor....the CA is acting as a representative to the creditor and whatever he negotiates is going to be forced on the creditor.
If the Collection agency bought out the debt, then they have every right to delete the entry.
Anyone who wishes to dispute this information please post a source to refute it. You listening Landlord?
Therefore, if you offer to pay a debt off, and the creditor still refuses to remove the negative information from your report, it's not because the law is preventing it....he's doing it to punish you. Plan and simple.
I have constantly recommended that if the creditor refuses to delete the information, don't pay the debt. Sure, you risk having a judgment against you, but the fact is most debts are not pursued, especially if they are under $500. |

Reguesting or receiving a "Pay for Delete" is neither illegal, nor is it falsifying *anything*. Credit reports are services provided by the credit reporting agencies, and the companies reporting to them pay for the service. If the company chooses to remove the item from the credit report, it's their contractual right to. The law says that *if* they report it to a credit reporting agency, it must be accurate and factual.
Removing the item does not violate the law in any way, and anyone telling you that "the law says they have to report you" is shoveling a load of BS at you.
You are certainly within your rights to approach a collection agency or an original creditor and ask them if they would agree to remove negative information from your credit report in exchange for paying the debt. Chances are, especially with an original creditor, they won't agree to it, because there's really nothing in it for them.
Collection agencies will often *say* they will delete if you pay them, but unless they put it in writing, the verbal agreement is worthless, and they usually won't do anything other than mark the account as paid. It will, however, stay on your report as a negative item (collection account / closed / paid).
One pitfall, though, is that by offering to pay a creditor or collection agency for the debt, you may be affirming its' validity. Be careful about doing this if you don't agree with the account and the amount claimed that you owe.
A pay-for-delete can be accomplished from time to time (I've done it myself), but I wouldn't get your hopes up too high, and if the creditor or collection agency counters by saying they will "mark the account paid in full", they're not doing you any favors - it will stay on your reports most likely until its' 7-year limit expires, with the added headache that it's awfully difficult to successfully file a dispute against a debt that you paid. |

The question is who are you talking to.
If it is the Original Creditor(OC) they will not remove the negative information. But, if you pay it off they must report it as paid off. It will be reported as Paid but previously delinquent.
If you are talking to a Collection Agency, they will often agree to delete THEIR account if you pay. However, they have no control over what the Original Creditor does. If they do not agree to delete their account, they still must report that it is paid and list a 0 balance.
As for the law the FCRA(Fair Credit Reporting Act) does not force a creditor to report at all. However, if they do report then the information they report must be correct. So technically if they remove or don't report the account they are not breaking any laws. Which is why you can usally get CA's to remove their listing.
Now, when you do make this offer, NEVER do it by the phone. Always send it by certified mail with a return receipt so you have proof that they got it. Do not send any money to them until you have an agreement from them in writting. |

i don't think you can pay to have it removed and such, but what you can do is wait seven years starting from the date the bad item that was put in your report then you can call them up and have the credit bureaus remove it for FREE. good luck |

Man, I would like to be honest with you. Right term for a credit is "credit history". Just think about meaning of the combination of the words: "Clearing or fixing a history". If you did a mistake in the past, then it is the history, if not - it is a falsification of the history. You can clear falsifications. Otherwise, accept history but work hard to fix your mistakes. In other words, it is much more productive to rebuild your credit history. You find hundreds of answers how to do that. Just do it properly and success will come. |

It sounds too good to be true because it is..the term "credit history" means just that to change your history fraudulently is deceiving prospective creditors into thinking your "pay history is what it isn't. If it could be done everyone would have 800 + ficos and we would have no need for bureaus! |

It is not a big secret to clear your credit - pay your bills on time and manage debt responsibly. You screwed it up - unfortunately it takes a long time to clear off your record. You can't buy your way clear. |
