We had a checking account when we filed. We also had a great lawyer. Get a good one and ask his opinion. It didn't matter on ours. |

Yes it is fine to have one! And if you have a house (mortgage) - your lawyer will tell you it's very rare that the Bankruptcy court will take that. Normally, as in our case, the lawyer will "homestead" your house so that you will keep it and keep paying on it and have a place to live.
BTW- when your debts are handled by the B. court, make sure they are all "DISCHARGED" and DO NOT allow even one of your creditors to file your debt as a "Chargeoff" which means they are looking at it even after the B. court has discharged it, as a bad debt. This happened to me. Had to get another lawyer and it got fixed pronto with them "apologizing big time" if you get my drift! |

It is always a good idea to have a checking account. Most lines of credit require that. However you wont be adding any new lines going thru a bankruptcy. I would keep it open so you could cash work checks, or gifts that are checks and have the ability to write a check if you need to. However , I would not keep any money in it because if anyone wins a money judgement against you in court they can take that as well as back taxes from your checking account, not likely but they can.

Don't close or do anything to your bank accounts while you are filing for bankruptcy. It could be construed as trying to hide assets.
HOWEVER...if you have debts with any of the banks where you have bank accounts, your bankruptcy attorney should have told you to withdraw the funds, close the account and put the funds into a bank account this is not going to seize your money. Many credit cards that are issued through banks have a provision to be able to seize your bank accounts and take the money inside if you default on the debt. You should do this BEFORE you file your petition. Once you file the petition, the trustee is in charge of your finances, and they will not take kindly to interference of that kind.
Also, it can be difficult sometimes to get a checking account after you've filed for bankruptcy and you might have trouble opening up bank accounts in general. Try to have a bank account, checking and/or savings, at banks where you don't have any debt, that way, after bankruptcy, your accounts will be open and you can use them as you are now.

Everyone should have a bank account. The courts don't care one way or another. Where would you cash any checks you get, at a check cashing store where they take a percentage of your check? |

It doesn't matter. You can still have a retirement account, account for paying living expenses and that sort of thing; you just have to disclose how much is in it. Once you have filed, no one will file a lien against it. |

Regardless of how many bank accounts you have, your assets are going to be discovered one way or another. It's best to leave your assets as you have them in your current state then file for bankruptcy. |
