My understanding is that if the check containing the words 'Paid in Full' is actually cashed, then the payee has accepted that payment and cannot make further claim. If the check was made-out for an amount less than the amount due, then the payee shouldn't cash it, but dispute the amount with the person making payment. This DOES NOT apply, however, to transactions conducted or performed (in full, or in part) by electronic means or electronic records. This means payments handled by automated systems, rather than human beings, which applies to most bill and credit card payments - so in these instances, the answer is 'No' - not true!. |

No, that's not true. Nice try. A check is a method for transferring money. If you want to place restrictions and conditions on the acceptance of that money, you need a separate document.
It would be like writing "Paid In Full" on a $100 bill! |

as you would be trying to obtain goods by deception (you are hoping the person cashing the cheque thinks you are only paying for some of it) then even if you did get away with it, it would be fraud.
not paying your bills - civil case, county court, CCJ most likely outcome.
deliberately commiting fraud - criminal case, Crown court, prison time most likely outcome.
so it might be the case, but do you REALLY want to risk it? |

Are you trying to say that if you buy goods for the value of £100 but write a cheque for say £25 for a deposit and write 'paid in full' on it then you do not have to pay the remaining £75? I doubt it very much as this sounds ridiculous, where did you even hear this |

You are talking about doing this to a debt collector right? Like one who is trying to get you to pay XXX amount of dollars which you feel that they added interest or other fees on to...while there are stories out there of such things, I doubt as to whether it would hold in a court of law. The bank doesn't care about whether you wrote paid in full on the check, all they do is pay out the amount that the check was written for, and legally that is all the check was intended for in the first place, a way to transfer funds. The banks will not get involved with type if a matter. |

As stated, this is not true.
The legal term for this is a "contract volition", which implies that both sides have come to an agreement to modify a contract (verbal or written). In this case, unless you can prove the other party agreed to this arrangement, it will never fly in court.
But....
Lets take this example. You owe an installment debt of $2000, payable monthly at $100 a month. You decide to start sending a check for $50, and they cash the check. If you do this for 3-4 months, you could argue that their continued acceptance of $50 constitutes a contract volition and they must now continue to accept that payment.
Note this isn't going to work on things like credit cards or most written loan contacts, as there is a clear wording that states you will end up owing late fees and interest. It COULD work dealing with a knucklehead collection agent, who is not bound by the original terms of your credit card agreement.
Either way, if you try this expect a court challenge, and you better do your research into your state law. Many states do not allow modification of contracts unless they are in writing. |
