no more than it is illegal for the debtor to agree to pay but refuse to do so.
If you read the fine print of your user agreement it is in there that they can and will do that (at least for credit cards) I am sure that all contracts have some clause in its legalese...that you must agree to before they extend credit to you |

No they actually sell it at a discount, then if you actually do pay, the collections company makes money by you actually paying what you owe. You may be able to get some knocked off your bill depending on what they paid. That's why they are so aggressive when trying to collect. |

And to all the people saying they don't sell debts...you couldn't be more wrong. After an account is far enough past due they can charge it off and sell the debt to a collection agency, usually for less then 10 cents on the dollar. |

Nope, not if you are late on the payments. You can look up better information under the "Fair Debt Credit Reporting Act". It will explain your rights and what you can do to complain. Most of the time the company has to follow a notification procedure: 15 to 30 days late, a letter, 60 day notification, 90 day demand and sometimes a 10 day demand for payment. Then you get sent off. BUT you have a great chance of negotiating your payment down.
GET any negotiations you make in writing from the collection agency FIRST before you make any payment.
Make sure you DO NOT let them do an automatic draft of your account at all. Not even if they say that is the only way the will do the deal.
Make sure if you do the deal, they have to remove the negative information from your credit report. They can do that, and you want this in writing as well.
Back up any discrepancies you may have with the bill with documentation, and document all phone calls you have with the collection agency.
You can tell the collection agency they are not allowed to call you at all. Not at work nor at home, note the date and time when you make this statement, because they may call you again and then you have the right to sue.

When they start calling you learn some tricks.
I had a guy calling me because I signed for a credit card with my son years before and my son could not pay the card.
The collector talked really fast and was very abusive. So I put the phone down on the desk and had lunch. I don't know how long he was on the phone.
These days you have protections against the collection agency thugs.
Know your rights. Learn to recognize abusive collection practices. Even if you owe a debt, a collector owes you fair treatment and respect for your privacy. Also, be aware that even if the collector's conduct does not exactly match the language of the federal Fair Debt Collection Practices Act, that collector may still be liable for its conduct. |

what makes it seem that way is that once the do this the original company turns a blind eye to you (why woud they still want to pay one of their people to talk to you further when they just payed an outside source to do it) |
