Is it legal for a credit agency to lie to me?
I received a message at work from a person who said he was from AAA and I needed to give him a call. So I call him back figuring it had something to do with my car. He was NOT from AAA. He was a collection agency wanting money from me. Is this legal? The company he was with didn't have AAA as an abbreviated name. Can they seriously do this??? I know the money I owe is valid, I called my insurance and they told me what was going on. But I'm SO mad this guy lied to me. I want to know if it is legal for them to do that. Thanks.

If you're just going to come on here and be rude to me, don't waste your time responding, I'll just report you. Can they provide you with false information in order to lure you into calling them?

Yes.
Rather, in many jurisdictions, yes they can.

Once you're talking with them, they can NOT lie to you about the contents of their files (i.e.: how much you owe, etc...)

They are also restricted on what they can do and say, and how often they can conact you, along with at what times. Check with the local BBB, they can give you the (local) guidelines.

If you want to screw-over the collections agency, talk to the original holder of the debt. Since they've already sold it off to the collection agent (assuming that this is legal in your jurisdiction), they may even be willing to settle for 60-80% of the original amount owed. ;)

They probably can unfortunately... I don't think they can call you however, if you ask them to stop. People from collection agencies are ruthless... they will try anything to get in touch with you. I would try to find somewhere where you can file a complaint. That's probably the most you can do.

Don't answer your phone anymore, or call someone back unless you know who it is.

It may be unethical but to call it illegal is borderline.

They can call you, probably not illegal to lie but certainly borders on unethical.

What you need to do is send then what is called a "cease & desist" letter. What this does is prevent them from calling you at home or at work and that they muct communicate with you only by mail. Send the letter by certified mail return receipt requested, that will cost you a little over $5.00 but is VERY important as that is your proof that you sent and they received that letter. If they fail to abide by your request and call you, they can be liable for up to $1,000 per incident.

Never deal with a collection agency via phone. Insist that all communication be writing.

It sounds like you did owe money to AAA insurance. If so it may be hard to prove if they did anything illegal.

Debt Collectors are not allowed to use a false names or misrepresent themselves. But in trying to prove it would be a different matter. All they would have to claim is that they did not say they were AAA but calling on behalf of AAA. Then unless you had some proof otherwise it would turn into a they said/I heard thing.

No it is not legal. But unfortunately you would have to prove that is what he said to you. It would be your word against his. I am not a bad person ether but sometimes things happen that we can't control so I go through the phone company and block those that want to be an _ _ _. It doesn't make my bills go away but I only deal with nice people not the other _ _ _.

Collection agency's will do anything to get in touch with you including calling neighbors, work and lying. They are trying to get their debt. Its not right by no means but they do it and I don't think there is any laws against it. One thing to try to avoid is to talk to them on the phone.. Put everything in writing so you have proof of everything because if its on the phone they can say they or you didn't say that. The whole thing rots!

yep. he prolly already tried to contact you and you didnt answer. saying AAA could be anything. the end result....he got you on the phone.......thats his job to collect debts.
