I do not believe it is legal. She needs to look up the fair credit and collection act. It has detailed descriptions of what credit collectors are allowed to do. I know that hey can be sued for their infractions in small claims court. Good luck. these guys really rat bastards as was stated before. |

It may sound bad, but it's perfectly legal. Collectors may call anyone that can possibly verify your location, but they cannot reveal they're collecting on an unpaid debt.
Collectors that contact anyone other than the debtor, can do so only once, unless they believe the information was false or incomplete.
The FDCPA discloses the guidelines for what is considered harassment. |

It is perfectly legal as long as the collector abides by the rules in the Fair Debt Collections Practices Act
From the Fair Debt website...
§ 804. Acquisition of location information [15 USC 1692b]
Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall --
(1) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer;
(2) not state that such consumer owes any debt;
(3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information;
(4) not communicate by post card;
(5) not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt; and
(6) after the debt collector knows the consumer is represented by an attorney with regard to the subject debt and has knowledge of, or can readily ascertain, such attorney's name and address, not communicate with any person other than that attorney, unless the attorney fails to respond within a reasonable period of time to the communication from the debt collector. |

this something bill collectors have just started..it is legal unless the neighbors tell them not to call again. in the event
they do they can fill a a charge of harassment against the collector, also i your mom answers the phone and tells them the same she can fill charges |

I know they are scantless, I had a roommate that owed a ton of cash to a collection agency. They called all the time and gave me information I did not even know about her! They told me that she was working at the local strip club, making X amount of money a week, and that she needed to give them Y amount per week. They should not have told me this, because when I told her, she was not upset with me, but she got a lawyer who got the debt erased because they gave out confidential information to someone else on the phone. |

A collector can call your friends, neighbors and relatives to try and locate you if you are dodging them or they can't find you. They can tell the third party who they are and why they are calling ("I am trying to locate John Doe regarding his Acme Bank Account"), but they cannot reveal your account number or other details of the delinquency. To stop them, you should notify them in writing that this is not acceptable behavior, however, the Fair Debt Collection Practices Act has not been interpreted to bar them from contacting your relatives and neighbors. Of course, these third parties might tire of receiving such calls and ask the collector to stop. In this event, the collector would be required to stop calling your neighbors and relatives. A common tactic collectors use is to find your neighbors through the use of cross directories, call them and ask them to tape a message to your front door to contact so and so. This tactic is designed to intimidate and embarrass you. It's one reason why you should deal with a collector rather than avoiding him. (If you ever receive a call from a collector asking you to leave a message on a neighbor's door, refuse to do so and demand that they not call you again.)

Sounds totally illegal to me; this is a form of harassment and intimidation. Your neighbors have nothing to do with your mothers credit cards. Think about this: they call the neighbor right next door... then they call the one two houses away... then they call one three houses away... and so on...then they call one 50 houses away, 200 houses away... when does it end? Does it end when they have called everyone in the town? In the entire state? In the entire country? There is a limit to permissible collection actions.
Sue the rat bastards who are doing this. |

no, that definitely does not sound right to me. it would be a problem if even your mothers friends were calling her neighbours, so for bill collectors to be doing that is not only illegal but it also sounds like they're breaching confidentiality. |

I think this is a tricky one. First off all states have different laws stating what is, and is not legal for bill collectors to do. So with out knowing the exact state laws your mom has to deal with my guess would be that maybe she used her neighbors as a reference when applying for "the bills"
Credit cards and other such companies will often ask for references when applying for a line of credit.
So good luck finding out the actual laws of your Mom's state. Also look into laws regarding harassment. I know that in some states if a caller requests them not to be notified anymore that they have to abide by that. Nobody deserves to have to feel harassed... especially neighbors, family and friends. Going through a financially hard time is stress enough! I hope this post helps! Good luck! |
