if in UK seek help financial advice from the citizens advice bureau, because if you make yourself bankrupt, and you owe monies property can be sold, house, goods, to pay off the debts. You can come to an arrangement through the courts, but he needs sound legal advice before doing anything

Yes, my uncle did. Bankruptcy means you declare yourself insolvent and then are protected by law from creditors demanding immediate payment. You then negotiate an agreement, usually via a solicitor, to pay back creditors over a number of years. Some of the debt may even be wiped. You won't lose your house but with the new era of financial conservatism we are about to enter, it's not a good time to have bankruptcy on your credit record...you'll probably never get another mortgage again.

It would be possible if he has other assets that they can retrieve money from, but on average you will lose your home, if you have a family the council will rehouse you. I have done this 4 years ago after an accident stopped me working it was the best move I ever made, all the stress and worry about creditors calling caused a heart attack its not worth it material possessions are of no value to you as a person, it is you that matters and the person you are that counts, I had a flash house a Jag and a Merc a swimming pool and **** loads of stress, I now have a lovely council house and an old mondeo but I am very happy and not at all stressed, tell your friend to move on and do what ever he needs to do to get rid of all the problems around him

yes it is , you only lose your home if you owe above a certain amount and have refused to co operate

Depends on the country and if you are from the United States also on your State.

What you should do is call a Bankruptcy Lawyer and ask them whether your house would have to be sold first to pay off the debts before you can consider to file bankruptcy on the rest of your debts.

If you are thinking that you can file bankruptcy on the mortgage of your house without losing your house... that is not a possibility.
Your house is the collateral for your mortgage. If you default on your mortgage payment the bank takes away your house and sells it.

There are some states that allow you to exclude your house payment from the bankruptcy. You would agree to exclude your mortgage lender from the bankruptcy, still pay your mortgage every month but file bankruptcy on your "unsecured" credit card debts, etc.

But this depends on where you live and in any case the details would have to be figured out between you and a competent bankruptcy lawyer.

The short answer is no.
Your share of the home will pass to your trustee in bankruptcy and even if you have children under 18 he will be able to obtain a court order to sell the property after 5 years

yes, but best see a financial adviser, if i remember rightly the council can even buy your house and you can live in it.

In some cases, bankruptcy will keep you from losing your home. But of course, your friend should consult with an attorney to see if he meets the criteria for keeping his home.

I believe the usual trick is to put everything except your business in your wife's name and then to wait until your business premises accidentally burn down.

you could always do the unthinkable & pay what you owe. You go bankrupt & this leaves the people you owe probably in the same position as you. Broke. Do they then file forbankruptcy ? & so on & so on
