I live in the state of Wisconsin. This is my first time postdating a check. I didn't have money in my checking account due to me having to withdraw it to pay a hospital bill. I knew I got paid on Jan. 1, 2008. I postdated the check for Jan. 2, 2008. That way it gave me enough time to put money into my checking account at WCCU( Westby Co-op Credit Union). I had no other choice but to postdate and send in the check or I would go to jail, due to mathematical errors in balancing my check book when I wrote Kwick Trip 4 checks that I had mo idea that they were bad, not to mention it is the first time I've written a bad check so this is a bit scary for me. The bank told me today the postdating check was illegal, I sure hope this is not true! Thanks to all those who answer this question truthfully and honestly.

I did'nt let the company know that I was going to postdate 4 checks either, so I don't know if this will change your answer either, on top of all of that I don't know if you're supposed to let the company now! |

I as a business owner, will accept a post dated check... but do need to be asked/told it is post dated so I'll hold it. This is not illegal to do.. the only problem is if you post date it and I want to cash it before that date... to bad for you. As far as being illegal.. how can it be? Maybe you just wrote the wrong date in, and who can prove otherwise and them who pays attention to the date.. you could write me a check for the 13th month, 50th day, year of 6903 and I would not even see it. The date has nothing to do with the check other them for your accounting purpose. |

it is not illegal. But a lot of times a bank will not look at the date and cash the check anyway. It is considered a form of tender no matter what the date is. |

I don't think it is illegal......but,it doesn't matter if you post date or not,the company or whom ever can cash it before the date you specified.You will have bounced charges for each check though. Probably 31.00 each. |

just ask whoever you are going to give the check to if you can post date it - don't be surprised if they don't give you your goods right away or book your reservation right away until check clears |

No, it is NOT illegal. But the check might still be cashed prior to your date. Why? Some tellers will overlook the date and cashed it. But most cases are if they made a deposit to there account instead of cashing it. Most tellers would be more cautious when they cash it. (I know, I used to be a teller and my co-workers usually are less careful when customers making deposits). I also had a bad experience with this lady (my sister's so call friend) that she wants me to purchase a series of facial for a discount. To save my self a trip to her place, and of course she was pressing it to get a check from me, I told her I will post dated it and request her NOT to cash it prior to that date. She done it and my check got bounced with an overdaft fee. Know I don't trust the process and business that promise will wait. Anyway, I personally think is a BAD idea. Just budget yourself better from now, and don't post date checks any more.
FYI - it is illegal to write a check when you DON"T have money in the account. But not posted date a check when you know the money will be there. |
