I'm having the exact same situation with a magazine company! We ordered/paid for it, and had it for one year but never renewed. Now they are threatening me with collections. Whoa! Big mistake! I'm armed!! I know the law.
Send them a demand to validate the debt. You want to see copies of the subscription card, bills, and payment records. (You do a record of this payment, right?)
In this letter, remind them that the statute of limitations has run out, and they will simply be wasting their time and money by continuing to pursue this.
Send this letter by certified mail/return receipt. KEEP YOUR PROOF!
The next step for these people is to send it to a collection agency. If this gets onto your credit report you can sue them immediately for posting unvalidated information to your credit report.

Odds are very good that you are in the clear. And, they cannot list it on your credit report since it is so old. Next time they call, get their address and send them a letter stating that they are to cease all forms of communication with you immediately. They are required by law to do so. If they don't you can take them to court. I also suggest you read the FDCPA so you can learn your rights as a consumer.

in most states statue of limitation is 7 years, so you have one more year to go. after that they can't collect your debt. |

there is a statue of limitations for every state so you will need to check it where you live. i can say for the most part they should be well outside the sol in just about every state. just because they are outside that time frame does not mean they have to stop trying to collect the money, they just can't take you to court over it. you will need to send them a letter saying all communication needs to be done threw the mail. |

I would have provided the same info as personal_finance_101--Good answer; give them the 10 pts.
Furthermore, it's been past 7 years, so they can't even put it on your credit report. I would put on the bills--"Unwanted mail. Please return to sender." There's not a thing they can do about it. Don't just put "Return to sender" the post office may confuse that with you moving and may return all of your mail. |

The next time they call you. Tell them you would like to dispute this charge and ask them where to write. Also ask them for the Name of the company that says you owe this debit. If they refuse. Tell them you are just trying to scam me and stop calling. Keep saying this for every call. Remind them it is the law. You have a right to dispute the charge. You are protected because you never received the merchandise or the magazines. |
