No, you don't have to pay them a dime to stop them from contacting you. All you have to do is send them a "cease and desist" letter, and they can not legally contact you again. You have a legal right to deal with the original creditor, NOT collection agents. Your debt will most likely go back to the original creditor or/and be re-sold to another collections company. Then just send the new company a "cease and desist" letter.
Also, there is a "statute of limitations" on debts. Depending on your state, the debt may or may not be past that limit.

On camera, has a great answer, you don't have to stand for harassing call. You need to check on the statue of limitation in your area. You can pay , but you will have to know, that this debt will still show on your credit report as being a negative for 7 years from the date of last activity. |

Cease & Desist letters are a joke.
Pay attention, this is the tip you need.
1. Never give your cell number
2. Get a specific kind of VOIP number. You will need a credit card, and about $100. to get started, but then it is only $15-$25 per month including long distance. Contact me if you want to know which one will work for this.
3. Once you have the voip line, you can log into it and set up certain features. Make it not accept any blocked or unknown numbers. Then set 'specific call forwarding', so that the numbers of the collection companies ONLY are forwarded.
Set the forward-to number to another collection company that is bothering you.
4. Forward your old number to the new VOIP number.
When the collectors call (or any othe annoying person you program), they will be forwarded to the number you set, but no other callers will.
So the collection company thinks its calling you, but calls another one and screams at them thinking they are lying, and they all get in a huge fight, while you never get a phone call. Soon they give up, thinking the phone number is wrong.
I can set this up for you for another $100. if you can't figure it out yourself with the VOIP provider I will send you. Just let me know. |

The first two answers are correct.
I have to disagree with Patrick to a small extent. What he's talking about is a "limited" cease and desist letter. Unfortunately, those are pretty hard to enforce. He is right though, that a "full" cease and desist leaves them no other option but to sue you, so make sure the statue of limitations has expired.
Credit Guy - What kind of advice is that? Cease and Desist letters a joke? I tell ya what, you keep calling me after I send a cease and desist and I'll show you just how much of a joke it is.
And while the advice you gave would probably lead to alot of comedy (believe me, I despise collection agencies) why bother going through that trouble? A cease and desist letter is only gonna cost about $5 when sent certified mail.
Hey Biddix - Do me a favor and buy a collection account of mine and try that crap. Just from reading your answers, I can see that whatever firm you work for is probably a lawsuit magnet. |

Actually it is another company that has bought your debt for pennies on the dollar. It is on your credit record no mater what you do. At this point I would find someone that can do a debt settlement and get the total dropped to half or less and do a lump sum payment. In the mean time, get caller id and just let call notesanswering machine screen your calls. |

The statement above to use a cease and desist letter IS correct, but you want to let them know in the letter that they are welcome to contact you by mail, but you will consider attempts by phone to be harassment.
If you send a cease and desist for ALL FORMS of contact, you're leaving them no option other than to sue you.
Depending on the number of years, they may not be able to sue you any longer, and eventually, they can't even report to credit bureaus. How long often depends on type of debt. |

Oh pleeze,,,,, all you have to do is tell them not to call you anymore, that's all it takes. If they do continue to call, they are in violation of the law, and you can sue them. But if you can pay the bill, and it's legit, why not just pay it? |

I have worked credit collection for several years now. There is one & only one sure fire, works every time answer to this question. MAKE ARRANGEMENTS TO PAY THE DAMN BILL, JACKASS! If you keep avoiding the collectors, you look like a fool since you know you owe it. You can rack up more charges on the debt because of how much the original creditor has to pay to have it collected. The best thing to do, seriously, is make payment arrangements. If the best you can, honestly, do is $25 month on a $40,000 balance, then they will accept it, as long as you continue to pay it. We only get mad & resort to things that irritate, annoy & frighten people when we know we are being f**ked with. By the way, if a collection agency actually bought your debt instead of it just being placed there, you can negotiate a small balance because they usually pay 50-70 cents on the dollar for the balance & still collect on the whole thing unless you ask for a sttlmnt. Today, I took a $10, 500 check payment from a woman who, if she had requested, could have had the same paid in full letter for her records with only $8500 paid. She didn't ask & we made that much more profit. Work with us & we can work with you. Avoid us, abuse us, do moron's trick with voip & we will not stop until we have either collected or passed it on to someone even worse! |
