Joint Bank Account Gone Fraudulent, Need Help! =)?
Hello,

I opened my Chase Checking Account when I was 15 years old (a minor at the time) with my dad as a join account. Well I just graduated from college and found out my dad sent the account to a negative balance due to his gambling addiction. I spoke to Chase and because I became an adult that the joint contract is binding. Hes long gone but that account and several of my other credit cards, random opened bank accounts by him stealing my identity, and loans via stealing my identity has basically screwed me over. Been fighting with all the fraudulent activity and I have been able to resolve a lot of them but the biggest thorn at my side is this joint bank account.

My question is there anyway to prove a history of fraudulent activity, or I guess anything at all, to relieve myself of this join account or am I just screwed over by a contract I signed when I was a minor? Thanks a bunch for readings this! =)

Oh I feel for you - this is not right.
I would suggest your call the Controller of the Currency at 1-800-613-6743. This is a dept. overseeing checking and credit cards. You can also go on-line to: www.firstgove.gov/ you might find some help there.
yes, you can prove fraud, but since the adult was given access to the account it may not legally be fraud. You might try speaking to a lawyer about this - some will consult with you for no charge. If he did open bank accounts with your identity you have recourse there from the banks as that is their fault. Maybe you can win enough to pay those debts.
I sure wish you luck with all this.
For everyone: Legally when you allow access to your accounts, credit cards, cars/keys you are giving permission for that person to do whatever they want and you tie the hands of the law. You can't even report your car stolen.

You would have to prove the account was opened when you were a minor and that all the transactions that occured were before you were 18. Once you turned 18, any activity that occured there after becomes a joint liability even if all the activity was done by your father.

Depending on the amount that was overdrawn, it may be worth discussing the situation with a branch manager to request the original documents pulled etc, but I do not see how they can no consider you an adult if the account was still open and valid after you were 18. Perhaps you can find some document that says it was a child's account and that when you turned 18, your father should have no longer had access to the account at which point, it would have been illegal for him to withdraw funds.

I would think that since you were a minor when you opened the account, you wouldnt be bound by the contract. There is a way to prove fraud, contact the banks fraud department. You can even go so far as to call your local police department about him steeling your identity to open other accounts, it is a crime.
My parents were on an account I had as a kid, and when they needed money they cleared it out.
Having anyone as a co-owner of your account is risky..

You need to start by filing a police report.

I am probably wrong, but since you were a minor, I would think that the bank was never a joint account, but you were just an authorized user. I hope someone else can give you more help with this.

If you enter into a contract as a minor you are not to be held to the contract, it is the defense on "infancy," it doesn't matter is you had a neg balance after you turned 18. However, if you simply explain this in letter form to the bank, you should be able to have the issue resolved. the negative activity for a bank account is only 3-5yrs, not 7 like neg credit accounts. So check and see if your time is up. It might be best to just ride it out. Call checksystems and agency like that to verif that you have neg. history w/ them. you may be worrying for nothing and just avoid Chase.

The fact that it was while you were a minor isn't a problem but if it went into a negative balance after you turned 18 you are responsible. If it happened when you were a minor they can not report it as a negative balance on your credit and they will have to take it up with your dad. Otehrwise you are responsible. Sorry!!! That sucks!!!

You can submit all the paper work you can but basicly you are screwed for quite a while

because most likely while your Dad was gambling you were
in class or at work. You could have your dad arrested but
I hope he goes into gamblers anonymous instead.

Well, it's my understanding that the reason they make you have a joint account when you're a minor is so the adult can have "responsibility" for the account in case it goes overdraft. So I would assume that he would be responsible for it.

Are you over 18 now?
