Last time i paid my credit cards was in 2005, they were charged off, now in collections, can I still be sued?
I checked my credit report recently, all the credit card companies have charged them off as bad debt. Can the collection agencies acutally take me to court to force a judgement? Can my wages be garnished even though the original creditor charged off the accounts as bad debt? I know my credit is screwed, I can live with that. I just don't want to wake up one day with a subpoena waiting for me at the door. I live in California, doesn't the statute of limitations run out after four years?

These collection account are sold from one company to the other. Without bankruptcy they will haunt you to the end. Yes one of the companies may sue you for the money. I do know someone that was sued for a debt that was 10 years old. File the chapter 7. You have nothing to lose. As matter of fact. There are companies out there that will give you credit after bankruptcy, The interest rate will be higher. But at least it will be credit.

Just because the original creditor wrote off getting anything from you in order to close out their books, doesn't mean that you are absolved of responsibility for the debts you incurred. What usually happens is, they sell the account to collection agencies for a fraction of what's owed, so they get SOMETHING out of the deal; then the company that specializes in collections owns the debt and takes steps to collect on it.

Yes, you can be taken to court, depending on the circumstances (whether they actually would or not is another question -- it often costs more than they could recover, and they may threaten with no intent of following through, which is illegal). Garnishing depends on the laws in your state, I don't know what's allowed in California. There are legal limits to what collection agencies can do; for example, they can't harass you at work if you tell them not to contact you there, or give information to uninvolved parties (such as neighbors or friends)

I doubt the statute of limitations has passed yet. You probably have a few years to go yet. But I tend to agree with the others - there is still a chance that they will sue you, but it's probably not likely, given that they haven't done it yet. But if they do sue you, you'll be on the hook for a pretty serious amount - principle, plus fees, interest, etc. HOWEVER, I interned as a law student at a legal aid office, and whenever people were sued over credit card debt, we told clients to insist on seeing copies of the original agreement/debt. Nine times out of ten, the collection agencies did not have these documents, and so were unable to prove that the defendant owed the debt. The burden is on the collection agency to prove you owe the money.

You could call and negotiate, but given that they can still threaten to sue you, you have limited bargaining power. I had a credit card that went unpaid for TWELVE years. It wasn't until I went to apply to take the bar exam - well after the statute of lim was up - that I realized that I'd have to clear up that bad debt if I wanted a law license. Even though I didn't tell the collection agency that I needed to clear this up, they still really wrestled with me to get me to pay a lot of money. It was too late for them to sue me, and the debt was no longer on my credit report, so as far as they were concerned, they should have been lucky to get a dime out of me. Still, the best I could negotiate was $700 on a principle of about $950. By the time I paid it, they were claiming I owed over $3,000, given interest and fees, so I guess the 700 wasn't too awful. You might try to call their bluff, dispute the amount owed, and demand proof of the debt. Maybe that will give you some bargaining power.

And, yes, if they get a judgment, they can and probably will garnish your wages.

EDIT to add: For goodness sake, DON'T file bankruptcy unless you are absolutely pushed to the limits. If a bunch of companies sue you, and they all start garnishing your wages, THEN you can CONSIDER it, but don't do it unless it's you're last option.

Here's another edit: If you do make a payment, FYI, it starts the statute of limitations all over again.

Yes they can.. I actually know someone who defaulted because her husband died and just couldn't keep up with them. 4 of them came after her. She settled with two up front and had to take the judgement and make payement arrangements to pay off the others. Also these account were charged off and sold to collection agencies/attorneys.

Most of them will let you get by with $25.00 a month payments if that is all you can afford. I wouldn't file bankruptcy unless you are about $30K in the debt.

I was in the same situation a few years ago. I elected to settle with the credit card companies.The collection agencies can come after you and sue you but it all depends on the amount. More than likely they will not because of the costs it takes to go through the legal process. They will just continue to threaten you with a suit and call all the time about the debt. I know that there is a statute of limitations and cant remember how long it is. Legally the collection agencies cannot keep adding up late charges on top late charges. There is a certain amount they can add on to the original balance. They will try to settle saying they will cut it down for example by 30% making it seem as though they are saving you alot of money. You dont have to buy into this. They bought your account for pennies on the dollar and are just trying to make as much as they can off you. I say settle it but tell them that you will only pay a certain amount. THE MOST IMPORTANT PART IS TO NOT PAY OR GIVE THEM YOUR ACCOUNT NUMBERS UNTIL THE AGREEMENT IS WRITING FIRST!

Yes. There is always the chance that you can be sued and taken to court to collect. Not only will you be paying for the credit card balances, but you also will be paying for the attorney fees from the companies who take you to court. It will be collected either by garnishing your wages or bank account. Since you have ruined your credit, you might as well file for bankruptcy.

They can take you to court legally, but they likely won't. I did the same foolish thing and just stopped paying my credit cards. I started getting settlement offers from all of the collection agancies that they were charged off to. I have since taken all of the settlements since they make my credit look better and they ended up being about 1/3 of what I owed. You should do the same when they start sending you settlements. They probably will not take you to court and garnish your wages, but it just plain makes sense to settle the debt. It doesn't go away for seven years for god sake.

not sure about CA SOL, but if the paper has been sold and resold, collectors have a way of popping up years later. If you have enuff debt, file bankruptcy if you really cannot afford to pay it. Or find a legitimate credit counseling agency. Best way to go actually.

Of course they can (and will) sue you. Why would you not live up to your obligations? Pay your bills!!!

Call all of them and work out a payment plan and try to get your interest lowered or stopped.

Then, make the minimum payments on every one of them. On the lowest dollar value, put all your extra effort toward paying it off. Once it is paid off, then roll that extra money to the next largest balance. Continue this snowball until all your debts are paid off.

You probably need to cut your expenses back to the bare minimum. Get rid of cable, cell phones, internet, etc. Lower your electric bill, gas bill, water bill, etc. Don't eat at a restaurant until your debts are under control. Take a sandwich for lunch. Cancel the gym membership.

Try to increase your income by getting a second job. If you have a car with payments, get rid of it, and buy a good dependable used car for CASH.

Go to the library and get "The Total Money Makeover". Read it and follow it carefully.
